Permanent residency / Citizenship in Sweden.

Hi friends, I have a question regarding applying for permanent residency and passport. December 2015 my wife is entitled to apply for a permanent residency (Then she have had the upphållstilstånd for 2 years). n december 2016 she will have been in the country for 5 years. So the question is, would it make more sense to wait and apply for both in Dec 2015 (plan a). Or should we go ahead and apply for the permanent residency now, and then apply for the passport for her in a second round (plan b)?

Originally we had planned planned to go for plan A, but we have ben told that it is the application / answer-time for permanent residence that has the long waiting times, so we are just losing time if if we don't apply now (plan b).

Since it is required to have a permanent residence permit, before you can apply for citizenship, by all means apply for it as soon as possible.

Sorry for this really lame question, but it is not straightforward to us where to apply for PUT on the migrationsverkets homepage.

Could you or someone else please confirm that we are suppose to chose the option Extending a permit under the tab moving to someone in Sweden?

It's the same form as when you first applied, you simply tick the box where it says you apply for permanent residence.

We didn't apply online before so this is completely new to us.

Where do you see the box to tick for permanent residency?

Okay, if you apply online you simply answer the questions on the site. A prolonged residence permit is by default an application for a permanent residence.

If you apply on a paper form it's the same form as the one you used two years ago. And here you should tick that you are asking for a prolonged/permanent residence permit.

Sorry for being thickheaded. This was a very clear answer.

I have an add-on question to both of you.

Are you 100 % sure that a PUT is still needed to apply for citizenship?

I am saying this for two reasons. A friend of mine was told by her handläggera that she didnt need her PUT - and she terminated her application and only kept her application for citizenship. Secondly I am reading on the Migrationsverkets homepage that uppehållsrätt og upphållskort (efter 5 år) is equalised with PUT since april 2015.

We don't work here, we are volunteers. So be patient, if your answer does not come immediately, be happy that it is free.

And yes, I for my part am able to read the Swedish law on citizenship, and am therefore 100% sure that your spouse needs a PUT, or the equal: have had un-broken EU-residence for 5 years. An EU-residence RIGHT becomes permanent after 5 years.

Sorry, I didn't mean to stress you, I am sorry for being impatient. I completely understand and appreciate your volunteering for this forum.

I see how your link to Swedish law is supporting your argument, but how do you think one could read that link I sent to you then?

I am sure that my friend could have misunderstood what was going on with her application, or she was simply lucky that the caseworker made an exception or something.

Anyway, we applied for PUT earlier this week - and will let you know how it goes. It will be an important travel document for us, so we are hoping it will not take 7 months or more time.

Is your friend's spouse/co-habitant partner Swedish? If so, the required residence-period is shorter.

It can also be shorter for those who came as refugees.

No my friend is like us. He's danish and she's non-eu - and not refugees.

Actually I have double citizenship now, but only recently, so in theory we are the same.

No it doesn't. It says that if you have had EU-residence for 5 years, you will have a permanent residence right. With a permanet residence right, you may apply for citizenship.

And furthermore: The link I gave you shows the rule of the law. And whatever some internetpage may give of information is not law. So even if the text you refer to said that you do not need permanent residence, it would not matter two hoots. It would not trump the law.

Dear Mh,

Thank you for helping reading the page, and I know what you mean regarding law is the law - and not even a webpage by migrationsverket is countable.

We have some good news. We got the permit today, got the letter this evening, extremely fast decision - and we feel very blessed :D
We are in good time for applying for the citizenship by the end of the year now.
