A few questions

Indlæg af cutiecat » 10.11.2015 02:01:51

So the thread below was really helpful to me as I'm in the same situation. What I'm wondering is if we are under 24? That is what differs from our situations here I think (at least, she didn't mention it).

And he could stay with her after they marry?

Thanks!

If you can use the EU-rules, you just have to be married and 18 years or older.

Ok. So if he moves to Sweden and I come to get married then we can move back to Denmark after some time, and it won't matter if we are under 24? What will need to happen before we can move back? I know I'm supposed to apply for residence somewhere and can stay with him awaiting the decision?

If the EU-citizen is working in another country - as an employee, self-employed or on a posting, his/her non-EU spouse, (grand) children or (grand)parents can stay there with him/her without having to meet any other conditions.

If the EU-citizen is a 'person with sufficient means' living in another country, his/her non-EU spouse, (grand)children or (grand)parents can also live there with him/her if (s)he has (for self and the whole family):

sufficient income to live without needing income support
comprehensive health insurance in that country.

If the EU-citizen is working in DK or receives pension from there (s)he can get the necessary health insurance for self and spouse through the Danish system. If the EU-citizen is another kind of 'person with sufficient means' (student, income from assets, big sum in the bank etc.) it is very difficult to get health insurance. Working a part-time job in Sweden will solve the problem.

HOWEVER - it is not strictly necessary to have the health insurance, as you after a period can move to DK using the EU-rules even if you did not qualify for EU-card in Sweden. In DK, when you have residence as spouse of an EU-citizen you will be covered by health insurance.

As a 'person with sufficient means' you should plan to stay about 6 months, during which time the non-EU-citizen should have a private travel-health insurance.

Thanks for your replies.

If we decide we want to marry and live in the USA first, and then we decide we don't really like it here and would rather go back, will we be able to move back to Denmark? Or will we still have to go to a different EU country before going to Denmark?

You will have to spend at least 3 months in an EU-/EEA-state and have a 'real residence' (not live in a hotel, but at a registered address) there before you can make use of the EU-rules to settle in DK.
