I don't think there is any point in particular that convinces them, and every case may be a bit different. As far as I can tell they will try to discourage you in every possible way, so maybe they take it when there are no more tricks to try on you. If you have overstayed just a few weeks, they may be easy on you (I really don't know). They will suggest that you go back to your country and apply from there.

Your partner must know his/her rights well, because they will try to convince you that you have no such rights. (I ignore your specific situation but I'm pretty sure you already got advice on this forum.) So basically your partner must stay calm and don't give up. I'm afraid that your spouse may need to take some vacation, since at least it took me a full week. Also be prepared for very unpleasant conversations. Some of the case workers will not be nice to you, not at all.

Thanks for the reply. I stayed bit like 3 months over,we will try and see. I am sure they cannot just throw someone out, I am not sure if it helps If I apply through a lawyer.
