Residence permit under family reunification terms

Hi everyone,

I have a question concerning residence permit under family reunification terms.

Here is the situation: I am soon getting married to a Danish guy, and we will apply for family reunification, while I will be on visa free – my country allows visa free for 3 months.

The things I have read on the official danish website Nyidenmark.... that there’s a possibility that they refuse your application for residence permit if you apply while being on a tourist stay, is that true? In what cases do they refuse the application of family reunification?

Is there anybody that has apply for family reunification under tourist visa? How long does it take when they start to process it, how many months ??

If you are staying illegally in Denmark, when you hand in the application, because you have already used up your 90 visa free days, then the application can not be processed. It will then be refused, and you will be told, that you have to leave Denmark immideatly, but that you can hand in a new application at the danish embassy in your own country.

The application might also be refused, if it is incomplete and lacking documentation eg. a copy of your marriage certificate. Preferably this should happen, already when you try to hand it in, so you can correct the problem right away and then hand in the application, only when it is complete.

Yes. About 60-70% of all cupples do that.

The service target is 3 month for simple cases and 5 month for complicated cases. Currently it might take a bit longer because of a big backlog of cases.

Do you know in what case, it is a complicate case? What makes it complicated exactly?

It is considered a complicated case, if the decision can not be made solely on basis of the information provided in the application + attached documents, but something need to be investigated further.

If for example there is suspicion, that your marriage is a marriage of convenience, and it is deemed nessesary to conduct a simultaneous interview with you and your spouse, then it will be a complicated case.
