This is my situation. I have been living in Denmark for past 4 years and I have a EU gf. I got a letter of refusal for my extension and have to leave next month. I don't mind going back, but I want to be with my gf and I cannot apply again for some tourist visa from India, since I actually fleed away from home to not get arranged marriage. I will be staying in different state and it will take sometime to establish, since I was away from Indian for 10 years. What options do I have? I researched and it looks like it will be noy possible to marry in DK, how ever in the marriage forum I saw it says under expectional circumstances if you lived long hear it is possible, assuming I appeal on the decision to buy us some time. I even looked in to sweden thing, but I dont think I can get the documents they require. I only have my passport with me. Any suggestions would be helpful and I will be greatful.

The 'exceptional circumstances' are if you 1) do not have legal residence, because you are an asylum seeker, 2) but still have been in DK for several years and 3) have had a longtime relationship with someone living permanently in DK, AND 4) have child(ren) together.
Your situation is not like that.
Are you sure that your appeal will mean that you do not have to leave?
If you do not have to, and you would marry anyway, then maybe you can manage to get married to your girlfriend, and if you by EU-girlfriend mean someone who is not Danish, then possibly you can then be entitled to an EU-residence card.

but is it possible to marry before they asked me to leave? what other options do I have if they reject my appeal also.

If you currently hold a valid residence permit, you can marry right away before it expires, then submit a new application on the grounds of being married and remain in Denmark while your application is being processed.

Yes that would be easy, but they refused my extension and asked me to leave next month.

But to refuse an extension isn't the same thing.
If you are currently in Denmark with a valid visa or residence permit, you can marry now. But once the visa or permit has expired, you can't.

yes i apllied for extension an year ago , which means i am in procedual or something time. Yes I am in denmark.

Thanks I will do it tomorrow. They rejected me because they said I didnt fullfill the requirements for 10 hour working criteria per last year. I have a lawyer but he is useless.

Is there any other suggestions. Any one tried to marry when there visa is finished and sent to renew ,got refusal and had to leave a month later.

You can marry in another country like Sweden but you can't submit any application in Denmark when you don't have a valid visa or residence permit. If your partner is willing, you might consider moving to another EU country for some time before returning to Denmark. That would be feasible

Thanks. As stated I have probelm getting any documents from India, since I am kind a running away from family and I lived in Europe for 10 years. Sweden needs documents like "Not married before" birth certificate and such. I have only passport.

If you have been living in Denmark for some years, most likely, you would need the documents to prove your status as unmarried from the Danish authorities. But in any case, it's up to you to do the research on where it would be possible to get married and what the required documentation would be.

Thanks. I did looked around and it looks like in Denmark I was told I dont need previous marriage certifcate and birth certificate. How ever in Sweden I need those, which I cannot. So looks like I am stuck.
