i am a moroccan who was married to a dane and applied for FR in 2011 and got refused coz of attachment and second time coz of the age.we got married in morocco and got also divorced there and i married a polish who has been living in sweden for almost 2 years now.
my polish wife has a construction company in her name in sweden and she lives with her brother .her brother has the house contract in his name and she has her address with him.my questions are :
1.can i apply for family renufication under european union laws taking in consideration the fact that we got married in morocco?
2.shall i legalize the marriage contract in the embassy of sweden or poland or the stamp of moroccan ministry of foreign affairs is enough ?
3.will they ask me in the swedish immigration for the divorce from my ex danish ?
4.will they require a house contract in the name of my wife ? what is the space in Meters set for every person living in the apartment ?
5.can i apply for family renufication online or we should go to the immigration office and subbmit our documents there?
6.how long does it take to get answer ?
7.can i work and study swedish language while waiting for the answer ?
8.i got a visa to sweden of 90 days and they gave me from 1 october 2014 untill 13 juanary 2014 and i will go to sweden 22 november 2014.can i stay in sweden untill 12 juanary for example ?can i visit poland with this valid visa ?
observation: i visisted migrationsverket website but i could not find enough answers .i would appreciate any help from the memebers and lawyers of this forum.thanks in advance

1. Yes. The important thing here is that your wife is Polish, not where you got married.
2. Your wife should ask the Swedish authorities what they require. She can ask at the tax office in Sweden.
3. No, it's irrelevant.
4. No requirements whatsoever.
5. It's up to you.
6. EU laws stipulate it can only take 6 months to get a EU residence card issued. However, Sweden doesn't follow this for the time being and you can expect at least 1 year or even longer before you actually have the residence card in your hard. Note, you have all rights to reside and live in Sweden once you hand in the application for a residence card so you don't actually need the residence card in order to live in Sweden, work in Sweden, register your address in Sweden, etc.
7. Yes, if you manage to get a personal number at the tax office in Sweden, you can also work and study in Sweden.
8. Yes, Poland is part of the Schengen area, so you can visit Poland as well as Sweden.

thank you sir..after your useful answers i understand many things that were vague to me before but what about my visa period.i have a visa of 90 days and it is valid from 1 october 2014 untill 13 juanary 2015 .actually i will go to sweden 22 november 2014 so do i have the right to stay in sweden untill for example 12 junary 2015 ?thanks

You have all rights in Sweden the moment you hand in your application for a residence card. So you also have the right to live in Sweden, the right to work in Sweden, etc.
However, you can't travel outside of Sweden until you receive the residence card.
