Denmark to Sweden and back again

Indlæg af expatguy » 21.04.2014 11:15:41

Hello,
I have a case which can be shown below.
I am from the USA, married a Dane under 24 years old, so I am non-eligible for family reunification by Danish rules. So we moved to Sweden, my wife applied for Swedish residency (which we are still waiting on) and once she gets hers, I will apply for mine. We would like to move back to Denmark at some point once I have my EU resident card. Is it best if we go by Swedish or EU rules when going through this process? Also, once I get my EU residence card, am I allowed to work outside the EU for a year and come back? Would the government even know or care? I do temporary contract work as an expat and back in the USA as a main form of income.

If you don't intend to remain in Sweden there is no point in applying through Swedish rules.

Please also note in Sweden you will pay tax from any income generated worldwide.

If you move back to Denmark after a few months in Sweden, you have to move there together with your wife in order to use the EU laws. That also means you have to keep your residence in Denmark. So you can't simply disappear from Denmark for a year.

But if after your work abroard for 1 year, both of you are +24, then of course you can just apply for a residence permit after danish rules, when you return. Or maybe the greencard scheeme could be an option for you? Have you studied the requirements for that at:

Thanks for the replies. I am a few points short of coming in on the points system, and my career is not on the positive list for the green card scheme.
Also, today we got a letter from "skatteverket" asking my wife a bunch of questions pertaining to her residency in Sweden(most of the questions are to confirm she is actually living here instead of in Denmark). For instance they ask if she sleeps in Sweden everynight and how many times per week she goes to Denmark, ect.
However, the last question ask where I am living. I was waiting for her to get her Swedish personal ID number before I applied for mine. Will this botch anything up or slow things down if we list I am currently living at the same address in Sweden? I am still here on my tourist stamp (good for 90 days) so I am not sure if its in our best interest to answer that now or after she gets her personal ID? I have not applied for anything yet
