Tourist visa and sponsoring

Hi guys,

The applications have been submitted and are now forwarded to US (according to the status I see online).

For some reason (i cant really put fingers on exactly what), I'm so anxious and nervous. I'm worried they will refuse to grant visa

I just can't help but feel so insecure.

I'm devastated. Today i got informed that their applications were turned down by the Immigration Service. The decisions have been sent to the embassy in Vietnam. I called the US. They only told me that it was turned down but refused to explain the reason why.

I have to wait to hear from the embassy about the reasons. I really dont understand

If i want to appeal, how long does it take for the Ministry of Justice to rule a decision??

Hi,
I've filed an appeal to the Ministry of Justice. They sent a letter to confirm the appeal receipt and to inform that it would go 4 months until I hear from them regarding their decision.

I wonder how many cases have got positive decisions after the appeals and how thoroughly the case will be reviewed before a new decision is made by Ministry of Justice.

I've enclosed additional documents that could be useful to prove the point and also written in hand a letter to appeal with more justification.

A recent answer to a danish politician showed, that only about 3-5% of visa decisions are changed upon appeal. So its a pretty slim chance, unless some obvious errors were made by Udlændingestyrelsen. Which does not seem to be the case for your siblings.

Thanks for the info, Fundiver199. I'm still waiting for the decision from the Ministry of Justice. However, do you know to which other authorities (i.e. court) I could forward the case if I still wish to appeal and have it reviewed?

You need to wait for the decision of Minestry of Justice. If it goes against you, there is nothing more to do, other than your siblings must get more established in their country of residence and then apply Again.

I suppose theoretically it might be possible to take the case to court. But that would be hugely expensive and a complete waste of money. Because the court would never ever challenge what is basically an adminitrative judgement.

It seems to be hard for you to comprehend. But the reality is, your siblings have no right whatsoever to get a visa. It is a decision of courtesy to give them one. And if they cant get it, they just need to stay home. So you or they really don`t have anything, which even remotely resembles a legal case worth taking to court. The judges would frankly just shake their head and then dismiss the case.
