Imigration service delaying Permanent Residence

Hi,
I have submitted application for Permanent residence on 2.july 2012. When I applied for PR and woman standing at counter did not take my temporary application Although I had with me. In January 2013 Imigration service asked me to send Temporary application.I submitted application and they received on 28 Jan 2013. I am waiting for long time and no reply from them.. I am very frustrated at this time why they are delaying..Some people got PR after 4 or 3 months and some are waiting for long period. I was student here and then doing full time since 2011. Sometimes I think that i should leave from this country.. May when next 7 months passed and they will ask for other document...
Please let reply what should i do..

this is very normal ..u are in a country that was listed some days ago by a world organization among those countries where there is racism and no tolerance towards foreigners just google it and u will see..the previous gouvernment made it completely impossible for people to get permanent residence in denmark or even normal residence and made rules completely against human rights ..and this gouvernment is making it little bit easier not because they want but coz of the pressure from the european union and world organizations of human rights..even if u submitt ur application and it is perfect they should always say that there is somehting wrong so that u will give up..do not give up ..u are working here and paying ur duties and contributing to their society..so the least compensation for u is to get a permanent residence like it is happening all over the world ..but i guess they consider people coming here like napkins as soon as they use them they u wanna throw them away...this is the link of the most tolerating countries in the world and sweden and norway and usa are on the top of the world:

Mh u should have enough courage u and other lawyers to criticise such rules who are against human rights instead of trying to prevent people from saying what they feel..but i guess such laws are good enough for lawyers coz there will be more complicated cases and then more lawyers will be requested and ofcourse everybody knows how much people pay for the lawyers in this country ..u are not better than all the world human rights organizations and united nations and european court of human rights that criticises such rules...just tell me one thing ..what does attachment to denmark mean ? is not that a way to discrimnate between people ..who is a dane and who is not ? and people who have their wives here or their husband are free to live where they want whether u like or not man ....instead of defending people ur defending the danish gouvernment as if they set u as their lawye hhhh

I am not an attorney, but I have helped a lot of people who have been at risk of losing their residence permit, by writing letters of complaint to the authorities on such people's behalf. I am happy to say in most cases with the result that the authorities have had to change their decisions and allow people to stay.

I have not received as much as 1 dkr. from those people for my efforts. I was working as a volunteer in a legal aid office until I emigrated from DK.

Here on ÆUG too I have been a volunteer, trying to give a helping hand to strangers who are in need of legal advice.

I am living in a country where NO foreigners will EVER get a permanent residence permit. I am living every day with the risk that the laws can be changed and I will be told to leave because my residence permit has been annulled. If I do not want to have to apply for a new residence permit every 5 years for the rest of my life, I will have to try to get a new citizenship and give up the citizenship I was born with.

THAT is why I say: if you do not like the conditions you live under in DK, you are free to leave.

There is a solution for those who don't qualify under Danish law and we have been through it. We moved to Sweden, Gothenburg and I got my residence card, went to study Swedish and we both with my Danish spouse worked there. I don't consider it as a bad experience or racism. I think it helped me to integrate into Scandinavian society and learn at least one Scandinavian language which is similar to Danish.After a year, we applied under EU law to Denmark and I got a decision to issue me residence card under EU law which means I can live with my spouse in Denmark and after 5 years can get permanent residence without any tension of work and language proof. I think best is not to criticise the country but just do something about the situation a person is. It was not easy to move to Sweden and to get thru unemployment but pull yourself together and do.

@shehzad, what was your basis for residence permit? Family reunification, study, au pair, green card, refugee? And if it was family reunification, was your original residence permit under the EU-rules or the Danish rules?

This is important, because the application form for permanent residence you would use depends on the type of residence permit you have. And some of the PR forms already have all the questions that pertain to an extension, while others do not. It sounds like the lady at the desk thought you did not need the extra application form for extension, but someone at Immigration does think you need that.

u must be kidding me ..moving to sweden is not an option for everybody in denmark..there are many people here who have their important work here and they can not just leave like this and going another country where they know nobody ..about language; i passed dansk 2 in danish without having been to school i studied danish myself..language is not a problem for people here ..the problem is the discrminatory laws..why denmark does not make lawys like in sweden to make it easier for people instead of going to another country and in the end they will come ?
about premanent residence i guess u do not anything about danish law..u wont get permanent residence here if u do not study in the last 3 years or work 4 hours everyday and continously for 3 years ..and ofocurse u are not lucky coz this gouvernment will be gone and they will not come again for more than 8 years coz venstre and dansk folkeparty and the blue gouvernment will come to the power soon and i bet u that u wont get permanent residence with them...u should have full time job for the last 3 years before u apply and that impossible now in this economic crisis...even if u do they will refuse u saying u should work in some voluantary activities..and am sure that they will make rules worse than they did before..in all european unions countries a permanent residence is given to people who came for family renufication after 5 years with no complicated rules..do not be that optmistic ..days will prove to u that i was right

Karim, melodisk will get a permanent residence in DK after 5 years without meeting any requirements on language or job simply because melodisk has a residence governed by EU laws and not under national Danish laws.

It's important you realise there are two parallel set of laws legal in Denmark: national laws and EU laws. It's only national laws that the Danish parliament can change.

Under EU laws its much easier to settle in DK, that's why so many couples go through the trouble to first settle in Sweden or another EU country before moving to DK.

Sweden by comparison is the Nordic version of the USA when it comes to immigration. The doors are open for obtaining greencards. Denmark on the other hand is not open for immigration. This difference is due to various political environments and values in Sweden and Denmark.

I do not think you know the difference between EU law and Danish law. I know Danish rules well. Danish government might change but it would not bother me anyhow because I am under EU law and the whole government of EU law would not change. I am an educated person who understands the difference and with a help of this site and great respect to the lawyers here I know I will get permanent residence card after 5 years of my living with a Danish spouse in Denmark under EU.
You should stop to criticize Denmark or let people down.

Actually I was student from 2006 to Jul 2010 and then green card. I am doing full time since 2011. My current green will expire September 2013 and I got in sept 2010. I applied for permanent residence on 2 july 2012 and they did not took temporary extension application as I told You. At then end of Jan 2013 they asked me to send Temporary extension form and then i submitted and they received on 28 jan 2013. I am worried first they asked after 6 months for one document even it was mistake by them and then they may after more 6 moth they will ask for another document. Please only relavent reply what should i do..

Ok, with your type of residence permit, they need the extra form for extension, so the lady at the desk had a temporary brain cramp.

They only promise that a case is decided within 7 months of the date that they have received all the information they need from you. So what do you do? You can only wait until July 28, 2013, because it was in January that they got the last information they needed. Hopefully you have gotten a letter by then explaining that they are checking your criminal record, and maybe, just maybe, you have your permanent residence by then!

Question is, can you complain about the lady at the desk not taking your extension application at the time? Was she deliberately trying to create a delay? And would it pay, or would it be better to just wait until July?

Hi,

currently i am on job card visa (valid until 2014) and living here with my wife and 1 child while my family(wife+child) are on dependent visa.

I am planning to apply for permanent residence permit in 2 months so my question is do i need to submit the application for dependent visa for my family along with the permanent residence application?
or
i can submit the application for my family later once i get the permanent visa or before expiring the job card visa ?

The two things are independent of each other. The important is, that your family members remember to apply for an extension, before their current residence permit expires. They can do that from 2-0 month before the date of expiration.
