ANYONE HERE WHO CAN HELP ME IN THIS SAD AND CRAZY SITUATION?

IM A RUSSIAN STADSBORGER, WHO GET MARRIED LAST YEAR WITH A DANISH MAN.

HE HAVE NOW CHEATED ME, SO I MUST LEAVE ALL THIS.

WHAT SHALL I DO? MUST I LEAVE DENMARK AFTER 30 DAYS? I DONT UNDERSTAND THIS SYSTEM 100%:(

PLEASE ANYBODY HELP ME.... I WOULD BE SUPER-HAPPY FOR MANY ANSWERS...

If you want to divorce your husband because he cheated on you, and you want to do it in DK, you have to apply to 'Statsforvaltningen' - read here how to do: http://statsforvaltning.dk/site.aspx?p=6396 (it's in English)

In principle the minute you leave your husband, or he you, your residence permit can be cancelled - in practice, it does not happen so fast, and certainly not within 30 days.

After you are actually divorced, you will receive a letter from the authorities saying that they intend to cancel your permit an asking whether you can give any reason why they should not. This is when you tell them if there is such a reason - if for example you have a very well paid job or some exceptional professional skills, or any other good reason.

Well, if only YOU want the divorce, you will have to prove that your husband has cheated on you.

That can be done in several ways, photos, e-mails, sms (remember ONLY if you have legal access to them, it is a criminal offense to read letters, e-mails and sms which are adressed to other people unless you have their permission to do it), hotel bills/bank statements for a double room where the other person visiting the hotel wasn't you, statement from witnesses etc.

If your husband also wants to divorce as soon as possible, it is enough that he signs a declaration that he did indeed cheat on you.

I think weeks, maybe a month or two, depending on where you live and how busy the 'Statsforvaltningen' is in your area, and whether your husband is cooperating. Also bear in mind that the summer holiday is approaching.

Should your husband not want to divorce, you have to insist that 'Statsforvaltningen' send the case to the court, and then it will of course take even longer. If you have no or very low income, you will be able to get legal aid, that is: the Danish state will pay for your attorney, so do not worry about the cost of a divorce case.

The 'Statsforvaltningen' is obliged by law to inform the US about your divorce, only after that they will take action.

No, not all lawyers accept to take on the legal aid cases, because they will only get the minimum salary.

However, you may contact a legal aid office, where they can direct you to the local lawyers who DO take on these cases.

The legal aid offices give free advice if you fulfill the criteria (less than 294.000 kr. yearly income), but they cannot represent you in court.

just one thing if you soon to be exhusban admit he cheatet you wil not have to give any prove of what so ever..

On the form you apply for divoice there is a spot where they ask you thise questen if you want a divoice fast and without the seperation, ant there is a place where you can say its becours of he cheated... then they send a form to him were he has to say yes he cheated and sign under... and thats it... you dont have to have any prove anymore, the cheating part just has to admit it on the form..

becours you are a foriegn you borth will be called in to a meating were they gonne make sure you understand what you have sign under and the consekvens.. if you dont want that meating then you can send them an email were you say you do not want this meating and that you know what you have sign under and you know the consekvens like it might mean you will have to leave denmark, then you dont have to do the meating
