Married to a German national

I am a filipino au pair in Denmark, got married to a German national, living in Germany last week also in Denmark.We talked to the German Embassy in Copenhagen to get more information on the legality of my stay and they said that I need to learn the basics of the german language which is not a problem for me. At the same time, they asked me if I can still stay legally in Denmark using my current visa which is still lasting until 2014.

According to the embassy, I need to leave europe and learn german A1 in my home country and apply again to be back here in Europe.

My question would be: Is there a grace period for me to stay legally in Denmark and learn the german language using my au pair visa without leaving the country? Since on the https://www.nyidanmark.dk/en-us/coming_ ... _pairs.htm it says that: Normally, you may not be married, have been married in the past, or currently be living with a partner.

Yes there is a sort of ”grace period”, because your residence permit is still valid, until it has been revoked by the danish authorities. You and your host family (if they know about the marriage) are obliged to inform Udlændingestyrelsen, that you have been married, and that your conditions have therefore changed. And you also need to inform Udlændingestyrelsen, if you stop to work for them, since this is also in itself a condition for having an au-pair residence permit (obviously).

Udlændingestyrelsen will then revoke your recidence permit and send you a letter, where they tell you, when you must leave Denmark. But until you get that letter, nothing has changed, except in your personal life.

I wrote to the Ministry of Foreign Affairs in Copengahen but the reply I got is for me to visit this page http://www.nyidanmark.dk/en-us/contact/contact-dalrir/ which I already know of with the telephone numbers that I can call. I was hoping to get a black and white answer about my case but doesn't seem too. I will try to call them though.

Lastly, do you know how long the grace period would be?

It is not a very good idea to inform Udlændingestyrelsen about your wedding plans in advance, because if they know about them, then they will be obliged to revoke your residence permit already from the day of the wedding.

It is not really a "grace period" but a processing time to revoke your residence permit. And how long that processing is, depend on how busy they are. It could be 2 weeks or 6 month, nobody know.

So all, that is sure, is, that the sooner you or someone else inform Udlændingestyrelsen about your wedding plans and the date of the wedding, the sooner they will start the proces of revoking your residence permit.

You are legally obliged to inform Udlændingestyrelsen about the wedding, but you are not obliged to do so well ahead of time. So for your own sake I suggest, you don´t inform them, before the wedding is a completed fact. This is fair enough, because at least in theory, the wedding is not "sure" to take place, before it is actually completed. Maybe one of you could get seriously ill, so you would need to postpone the wedding, or your relationsship could break apart. Many things could happen, that would make wedding plans change, so no need to inform Udlændingestyrelsen, before its completed already.
