American marrying a Danish Man

Hello everyone,

I am hoping that I can get a little bit more insight about my situation. I am currently planning on marrying my danish boyfriend in Jan in Denmark. I have spent countless hours talking to immigration and searching through the official immigration websites, but I am a bit unsettled with my situation.

We meet ALL of the requirements except the 24 year rule. I am 22 and he is 24. He however has a masters in Political science and is working as a consultant. We have looked at the positive list and he feels that the type of work he does would qualify as a positive job (he does lots with business controlling, network consulting, and project management-all titles on the positive list). The rules state that if his job is considered a positive list job then we should be fine( they will uplift the 24 year rule and the attachment policy), but the list is very vague and the titles are a bit strange... does anyone have any advice on how our chances may be or have been through a similar situation ?

As far as I know it is very difficult to convince the US (short for Udlændingeservice) that a job is equal to a job on the positive list, if the job TITLE is not the same as one on the list.

One way to find out is to apply while you are still in America. If the answer is positive you can hop on a plane and begin your new life in DK with all rights and duties, you will be given a cpr.no., get health insurance and have the right to work immediately.

If the answer should be negative you may have to consider the possibility of moving to a neighbor EU-country. This of course is only an option if your boyfriend will be able to commute to his job in DK from his residence in the other country. Mostly this solution is used by those working in the Copenhagen area, or close to the Danish-German border (or of course those who can find a good job in another EU-country).

The interpretation of the positive list is very narrow and not purpose oriented, which is weird but non the less true. And the main deciding factor will be a so called DISCO code from his employer, which tell what kind of work he is doing. I therefore suggest, that he obtain the DISCO code from his employers resource management department (personaleafdeling) and find out, if it is on the list or not. This can surely be clarified by simply asking Udlændingestyrelsen about it, since it is a fairly simple “yes” or “no” answer. Or perhaps the list of approved DISCO codes is already available on their homepage http://www.nyidanmark.dk

If his DISCO code is not on the positive list, and if he don’t have children from a previous relationship, it is a complete waste of time to apply for family reunification, since you don`t fullfill the 24-year age limit, and since there is then no compelling reason, why you could not just choose to live together in the USA. So in that situation, it will be a certain "no".

DO you know if they automatically look at the DISCO code or if they take into account what the employer actually states that he does? Immigrations does not seem to be able to give a straight answer on this situation. If they don't bother to look at the contract and/or letter from the employer than why do they ask for it? If they strictly go on the codes then obtaining this information seems pointless. So do you know if they look at the information that we give them or do they strictly look at the code?

No I do not really know. But my clear impression is, that the whole administration is narrow and square. So I would fully expect, that the DISCO at least play a very large role, since it is an easy and fast and completely objective tool to use. US dont really like to many individual og subjective judgements since:

a) It consumes time, which they do not have
b) It creates a risk that they dont treat people equally and maybe even a risk of corruption among their employes
