European health card and Försäkringskassan

Hello there!

My husband and I need some advice regarding social security in Sweden. We have been following the ægteskab uden grænser forum and are aware that you are on top of things, and were wondering if you would be able to advise us or have the time for it.

First some background on our situation, my husband is Danish and I am Bolivian, we have been living in Malmö since December 2011. We both have a personal number. I have a residence permit given to me on the basis that I am married to a EU citizen who is a work taker in Sweden (EU rules). I got this residency on December 2011 and at the same time I applied for residence permit under Swedish rules (uppehållstillstånd) but Migrationsverket hasn't reached a decision on this application yet. It is also important to add that we are planning to stay in Sweden for 5 years in total so I can become a Swedish citizen.

My husband has worked in Sweden for 16 weeks between December 2011 and July 2012 (12 weeks on a full time contract). During this period of time he also has been self employed in Denmark. Now he is only working in Denmark. To sum it up, most of my husband’s income is generated in Denmark.

Now regarding social security issues, my husband has been registered in Försäkringskassan since he was employed on a 12 week contract, when we moved here. I'm not registered yet because the period he has worked in Sweden is not enough for them to register me. However, they are considering registering me on the basis that he is a person with sufficient funds, we are still waiting for their decision on this matter.

In any case, the important thing is that we have realized being registered in Försäkringaskassan might not be the correct option for my husband because most of his income comes from Denmark and he should be socially secured there. So we are researching the possibility for my husband to get the EU blue health card, and hope that Försäkringskassan will accept registering me because he is a person with sufficient funds...is this possible at all?

My husband called the Borger service yesterday and they said he should get the health card (the yellow card) to be social secured in Dk but we understand that card doesn't cover all heath issues in Sweden and it wouldn't cover me, if I need it to get registered at försäkringskassan, is this right?

Onita, if your husband is working in Denmark, you should be able to get the Danish card also. It's important the card is issued in your name and not only that your husband has it.

What card are you referring to? I'm confused.

I thought to update you on the following:
I was just on the phone with Försäkringskassan, and they say I am registered with them since July 2012, in the basis that my husband is a person with sufficient funds and I have a right of residence permit in Sweden valid for 5 years. We didn't get the letter yet because we changed our address and the letter had to be re-directed. They said I don't have the right to sickness or unemployment benefits (since I don't work in Sweden, I'm just studying).
They also said my husband should fill in a form 6215 which is in their website to let them know he works mostly in Denmark and a bit in Sweden. As a result HE will be unregistered from Försäkringskassan and this doesn't affect my registration.

So, know I would like to know which card does my husband need to be able to use the medical system in Sweden?

I'm referring to the European health insurance card that you ask about. You need to have it issued in Denmark in your own name as the spouse of an EU citizen who is working in Denmark.

Your husband will need the same card. It's issued by Borgerservice in the muncipality where he is working.

I don't understand why I need to have the card issued for myself too if I am registered at Försäkringskassan? isn't that the correct social security for me?

As a spouse of a cross-border working union citizen, you're entitled to the health insurance provided by Denmark. Sometimes Försäkringskassan will ask for it too. So better be up front and get it as it only gives you more options.

I see...once again thanks!

I just thought of pointing out my husband is self-employed in Denmark and works 4 days a week there and 1 day a week in Sweden...just in case this changes in anyway your statement of him being a cross-borders working union citizen. Secondly, I don't fully understand why is it relevant he is a part of a workers union? sorry if this has an obvious answer...I'm just not familiar with it.
Also, could you tell me where exactly in the EU law (or other law for that matter) does it say I am entitled to health insurance provided by DK? I ask because my husband was at the Borgare office today and they wouldn't give him the blue card for him or me. They said he needs first an special yellow card and then he can apply for the blue card for us...and I would like to make sure that is what is lawfully correct.

I don't write anything about a workers' union (fagforening in Danish). I write that he is a working union citizen crossing the border and as such he is entitled to certain benefits from Denmark.

Yes, your husband first needs to get the special "sundhedskort for grænsegængere". This is the yellow card that looks similar to any Danish "sundhedskort", except it gives him certain priviliges in Denmark such as being able to freely choose a doctor in Denmark any time he wishes. Your husband ought to pay a visit to Øresund Direkt which is located at Stortorget in Malmö. They provide cross-border information on all these kind of issues related to living in Sweden and working in Denmark (or in both Denmark and Sweden simultanously).

to find a law that says I have the right to get social insurance from Dk?

I have a question regarding blue insurance card in sweden. I m from russian but married to danish citizen. we moved to gothenborg in march 24, 2012. my husband used to travel from frederikshavn to gothenborg from april till september, until he got a job in gothenborg. I got my temporary residence card under eu rules in june and i also have cpr number.
I applied for blue insurance but they have refused me. I m planning to re apply but I would like to know if i have any rights to get a blue card? Could they refuse because he is danish citizen?
How important it is for me to have the card? my husband obviously have danish insurance and blue insurance as well. We are planning to apply to Denmark under EU later.
Is it important for Denmark when i apply under EU rules or is it important for Sweden if i change my mind and decide to apply for permanent residence to have this blue card?
what documents should i attach?
I attached marriage certificate, cpr, copy of residence card, desicion from migration board do i have to write them something?

Who refused to issue the card? The authorities in Sweden? Or the ones in Denmark?

Have you been registered at Skatteverket in Sweden and at Forsäkringskassen? To be so is obviously important, if you are going to stay in Sweden and need health care or want to work.

But once you are in Denmark already, it is completely worthless to have been registered at Skatteverket. It does not give you any advantages in Denmark whatsoever. So if you are planning to transfer to Denmark, you should perhaps make an evaluation of the benefit of getting registered at Skatteverket vs. the amount of work, it requires and your expected remaining time in Sweden.

we live in gothenborg.I m registered at skat, i got my cpr in august. in september i applied to get blue health insurance card at Försäkringskassan and forwarded necessary documents but recently they sent me a refuse in the health card.
We would like to apply to Denmark under EU law in a year or more because we want to be sure i will be granted the card in denmark because my danish husband lives and works in gothenborg, but while i m here i would like to have the health card as i m planning to work. and on the other hand it is good to have everything that is needed in case denmark refuses, when we apply and we will have to stay here.
What shall i do to get the health card`?
