Back from Sweden. Getting a job in København

Hey guys and girls..

As always thanks to all that put so much effort into this community. There truly are some unsung heroes out there watching our backs.

Quick question/situation:

Me and my lovely wife have just 3 weeks ago moved back from a wee six month stay in Malmø. Most of you can read between the lines when the words '6 months' and 'Malmø' drop on the page. But for those who can't; we've been working around family reunification through the EU rules.

Now we are back. For good. *touches wood*

So the situation is that currently our application to the Immigration Department has now been in the pipes for almost three months now and I have just found a job opportunity.

As it stands I am NOT able to register my current permanent address, therefore unable to get a CPR-number, tax code, etc. And in this modern age those are most integral in the job market it seems.

I had my first trial tonight and it looks to be fruitful. I have a Swedish opholdskort.

What are my options here? Is there anything I shouldn't confess to my employer and hope Immigration service comes through on time? Do i actually have rights to work whilst my case is pending for opholdskort here in Denmark? Other things....?

You have the right to work from the very moment you have submitted your Danish application form to the authorities. On the other hand: If, and only IF, the authorities deny your application, you have been working illegally, which might give both youself and your employer a big fine. So it COULD be an idea to wait for the answer on the residence card first.

But it is your own choice, if you will wait, or if you will go for it. If you are absolutely sure, that you and your spouse fullfill all the requirements, I see no hinderings for you to start working on the spot.

To get a personal ID-number, so you can start working, you can bring the very same documentations to the municipality office, as you brought to the immigration. Pointing out, that you apply according to the EU-regulations.

You can never be 100% sure that our case will be approved. But we're pretty confident that it's water tight and can't see any flaws. I was quite substantial documentation and then some.

So if I read you correctly, are you saying that I should come to København's Kommune with the exact same documentation I took to Immigration Service? In which case I am probably going to wait it out, since it took us about a week to compile everything for our case.

However if you're sure that I'm able get a CPR (personal number) by doing this. I may consider doing it.

How long is the turn over in getting a personal number if I am to apply for it this way. And will I legally be able to work straight away?

I think it is really difficult if not ompossible to get a CPR-number without a residence card. But please go for it and report back about the results. You might also ask your employer to write a letter to Udlændingestyrelsen explaining his intension to hire you and ask, if they could possibly give your application for a residence card priority, so that it can be finished.

Yes I think its worth a try. If I was working in "EU-kontoret" and received such a letter from a danish employer, and the "servicemål" was almost due or already overdue, I would feel a strong urge to just get the application finished, unless it was an unusually complicated one.

I am a public servant myself, and it is rather common in the danish public sector to at least consider the consequences of a slow processing of an application when carrying out our work. At the place, where I work, we will do our best to not become responsible for something, that e.g. result in a big financial loss for society. This is not a "written rule" but just a general understanding and in my point of view common sence.
