hi good day,,,
im a filipino gay soon married to a danish man. im just asking if what happen if after living in sweden, we can come back here in denmark that no problem,,, how can we sure about that? please answer me,, im confused thanks

If you can return to Denmark after a stay in Sweden and getting married depends on your husband's establishment in Sweden and his ability to prove this.

For instance how long he has had a residence in Sweden, his ability to document his daily life in Sweden with you, and so on.

In general at least 8-10 weeks with an established Swedish residence will suffice.

When a EU-citizen eg. a danish citizen has resided in another EU-country than his own, he is entitled to bring his closest family with him (spouse and minor children), if he move back to his own country. We call this family reunification after EU-rules.

Skaanebo is referring to the minimum duration of a stay, that is required to have resided in another country than your own. Eg. if a danish citizen has stayed in Sweden for 2 days or 2 weeks, he has not resided there but only visited.

8-10 weeks is kind of a border zone, where you might have resided or might have visited depending on the curcumstances of your stay. If you have stayed 8-10 weeks in a hotel room or a rented holiday house and not carried out any economic activity, you have probably still only visited and not resided in the country.

However if you have stayed 8-10 weeks in an apartment, which you rented on a time unlimited contract but just chose to terminate very quickly, if you gave up you previous apartment in eg. Denmark, if you moved all your ferniture to the new apartment in Sweden, if you opened a swedish bank account, if you signed up for swedish insurances, opened a swedish telephone and signed up your children for swedish school or kindergarden, and if you have had a normal "everyday life (worked, studied etc), then you have probably resided in Sweden.

The duration of the stay is thus only one among several things, that the danish authorities look at, when deciding who have resided in another EU-country in Denmark, and who have only visited there. And their evaluations have become very strict, and the fraction of rejections of applications for family reunification to danish citizens after EU-rules are around 40%. So this is not something to be taken lightly.

thanks for your response mr.fundiver,, im barely understand now,,,my visa here in denmark is an au pair visa,, my questions is,,,after we get married here,,, what visa i have to stay here in europe,, either in denmark or in sweden? and how long can i stay here,,, what papers should i can fill up? tak og god dag,, :D

In Sweden you apply for a residence card and the same will apply when you move to Denmark.

Your Danish husband can read the guidelines under "jeg vil" at the top right corner on this site.

Why don't you let your husband read it and translate it for you?

I'm afraid most of the guidelines on this site are in Danish.

As for applying for a Swedish residence card, visit www.migrationsverket.se - their guidelines are in English too as are the guidelines provided by www.nyidanmark.dk

if ever i got my residence card on sweden,,, can i go for language school there for free? can i find a work there? what kind of visa i have after married?

Once you get married and hand in your application for a residence card at the Swedish Migration Board ("Migrationsverket") you obtain all your rights immediately.

That is you can start work right away, you can get free tuition and all the other public benefits of being a resident in Sweden.

Everything is explained at www.migrationsverket.se if you read the section about family unification with an EU/EEA citizen.
