MARRYING AN UNDER 24 Dane!

Hello!
I have tested myself with regard to PointSystem, and the result is:"Congratulations, you have enough points to stay in Denmark" My problem is now as follows: my partner is a Dane and 20 years old. Does the 24 years old rule concern her as well? Simply speaking, I would like to know whether she must be over 24 years old or not.

Yes, both of you should be over 24

OR one of you have a job on the 'positive list' (http://www.nyidanmark.dk/da-dk/Ophold/a ... ersigt.htm)

OR one of you have a child with another person who is Danish or have permanent residence in DK, with which child you (or the other parent if the child is living with you) have regular and frequent visits

OR your Danish spouse have a medical condition that makes it unreasonable to demand that she leave DK to live elsewhere with you.

There are a few other exceptions, but they probably do not apply to you.

In addition to the previous answer: If you are a EU/EEA-citizen yourself, then the point system, 24 year-rule and other "disturbances" is no longer valid, because it is a violation of your rights to free movement according to EU laws.

And then remember, that marrying another person and to stay with that person is two different things. Disregarding the point system and 24 year rule, you can get married to your partner any time, if you are beyond 18 years of age. But according the strict Danish native regulations, you cannot live here in Denmark, unless you and your partner fullfill each and every demand. The point system will be implemented from 1st of July this year.

Dear Jan. In addition to the other excellent answers, you have received, please note the following:

For now Denmark has a "24 year rule" i.e. both you and your spouse must be at least 24 years old, unless for some reason it is completely impossible for you to live together in your country.

If a proposed legislation is approved by the parliament, from 1. july 2011, this rule will be replaced by a "point system". In your case, you will then need to gather 120 points. When both you and your spouse is at least 24 years old, this requirement will be reduced to 60 points.

If you can not gather 120 points after the proposed system, the EU-rules or living outside the EU is still the only way to go, unless you have patience to wait for 3-4 years to live together.
