divorce, then remarry, then stay in DK

Indlæg af ms_worry » 23.04.2018 14:01:49

I (non-eu citizen without children and job) am a temporary residence permit holder based on the marriage to a Dane and I have been staying in DK for 2 years. Now I am going to marry another Dane. So first of all, I have to divorce.

1) once both parties agree the divorce and done online, Should I remarry until I get divorce certificate in e-bok, or I can do it right the next day?
2) After remarry, submit the family reunification application to immigrants agency.
3) Stay in DK waiting for Immigrant agency’s decision.
4) all above steps must be done before Immigrant service makes decision to revoke my old residence permit due to the divorce.

Is my thought correct? Is there anything special I should pay attention to avoid leaving DK after divorce?

Besides,
1) what kind of document I should prepare to remarry in dk? Is my notarized and legalized birth certificate needed again? (my first marriage was registered in DK)
2) When is the new family reunification rule expected to be approved by parliament? Once it becomes law, will it take effect retrospectively back to the date of March 16, 2018 when it was presented to Parliament?

Thank you for the help!

You cannot apply to remarry until you can prove that you are divorced, but you can apply as soon as you have proof.

Your birth certificate will be required too.

The new rules are expected to take effect as of 1. of July. Most likely there will not be applied retrospective rules on applications handed in before that.
