Stop working, but getting married (EU + Non EU)

Indlæg af Annidora » 15.12.2017 10:44:33

Goodmorning!

I have read several topics on marriage, pregnancy and (permanent) permit to Denmark, but I still havn't found my answer. I will try to explain this in short.
  • I moved from my EU home country to Denmark 4 months ago
  • I am from the EU and got my working and residence permit (4 months now)
  • I am working and currently receiving the minimum required amount of DKK (about 6500)
  • I am also self employed in my home country, but waiting for my application from SKAT to move it to Denmark, and will earn minimum 15000DKK/month
  • My girlfriend is not from the EU, but has a working Visa and residence permit (~30 months)
  • She is going to Sprogcenter and got her Level 3.2 (?) or higher, can't remember exactly
  • She has applied for a 1 year visa (extension) few months ago, but it's busy and she's still waiting
  • She has received her 'temporary' visa to go on holiday, visit family, etc., valid until march 2017
Because of her employer harassing, exploiting, forcing her to give 5000DKK/month back (happens for the last 24 months) and stealing money from her, she has decided to stop working for him per januari. She is working for him since 2 years. This makes her not having a job anymore so the chance her employer will 'lock' her Visa will be big. So she is forced to get back to her home country within a few weeks after januari or 3 months after januari.

We were planning on getting married in 2018, because, obviously, she said 'yes' before! But now I think we've got a problem, because the chance she is pregnant is also big (the first symptoms are there and we're waiting for the next 'circulation').

What is the possible, correct and legal way right now? We've been thinking about two things:
  • Getting married (anyway) before her Visa expires or gets locked - but then what??
  • Getting married (anyway) after her Visa expires and do a family reunite - but how, when and rules?
If anyone is here able to help us out or points us into the correct direction, we would be absolutely happy and definitely thankful!

Thank you for any reply!

Get married before her visa expires, because since you are an EU-citizen working in DK, that will give her an immediate right to an EU-residence card. As soon as the ink is dry on the marriage certificate you can go to Statsforvaltningen and apply. It does not matter whether she works or not, as long as you do.
