Divoice under EU law

Hello,
Me and my ex wife were married for 3 years and we lived in Denmark for 2.5 years, I have job all the time, but with two different employers, we’ve got divorced few months ago, and I just received an e-boks from Statsforvaltning called”I polysinger om personalige forhold og tilknytning til Danmark”. Does anyone know this form? It’s just regular check or there are some special things that I need to be aware of? Are there any reasons that they refuse me to keep my eu visa?

The thing is that you COULD loose your unconditional right of residence now that you are no longer married to an EU-citizen.

That is because your right to continued residence is now conditional of your having been married for at least three years, and during at least the last year having been living in Denmark, of being able to support yourself, and of your not having moved out of Denmark since the divorce.

Therefore it is normal that Statsforvaltningen wants proof that you have preserved your right of residence. According to your information you have. You should not worry.

Hi, thanks for the answers, there’s another thing, I have a baby with another woman, the baby was born after we divorced, do you think this will be a problem to influence my eu visa?

No, no problem, actually if you have shared custody or at least regular visitation with your child (every other week-end or more), this is an additional reason to let your stay in DK - provided that the child is living there, of course.

Hi,the baby’s mother is not an eu-citizen, she only has permanent residence in Denmark, do you think this is still a plus reason to let me stay in DK?

As long as the child lives in DK, no problem. Citizenship doesn’t matter.
