Deadline to leave DK after Family Reunification application got rejected

Hello everyone,
I was wondering if anyone can help me with my situation. i got refused to stay in Denmark under family reunification and was told to leave 5 days after we just received the letter. I have no problems with the decision, my concern is the date for me to leave. We're shocked to know that I have been given ONLY 5 DAYS to leave DenmarK and I think it's too soon and unfair. I've read some threads in this website that they were given a month to leave and I think it's fair enough. Is there any way that the danish immigration can give me at least a month to leave so that we can prepare? I'm gonna leave my partner in 5 days and we both need extra time to fix everything (tickets, plans, & deal with the separation). Can anyone please help me or have any advice on this? I would greatly appreciate it. This is really stressing both my partner & I plus we don't have much time left. We want to enjoy the last moments together since we're not gonna be seeing each other for a long time. :cry:

Sorry, 5 days cannot be extended.

But I believe you can appeal the decision on not being granted a residence permit if the reasons for the rejection have changed in the meanwhile. For instance if you have moved to a new place so that you now fulfil the housing requirement, then you may ask the authorities to consider this.

But it's difficult to give you any advice when you don't explain the reasons for the rejection.

My apologies @skaanebo, and I appreciate the response. We applied for a Family Reunification under cohabiting partners July of last year and we just received a "Refusal for a temporary residence" letter from Udlængestyrlsen today, stating that I need to leave Denmark on the 12th of this month. We called Udlængestyrlsen and asked for a reason for the sudden 5-day deadline, they said the decision was already made on the 29th August. That's 9 days ago and we never received any letter from our personal emails or my partner's eboks of such information. So now we're left with 5 days when it could've been 14 days of preparation to leave Denmark. This is really stressing us out and we really feel it's unfair we had to suffer for their mistake.

And with your question about the reason of our denied application, it's because of the addresses we lived together in Philippines were invalid. My partner (Danish) & I, have been traveling back and forth Denmark and Philippines for the last 3 years and my partner didn't know he needed to change his address in the danish system while being in the Philippines for the address to be valid.

Do you think there's anything we can do to have a week extra to leave Denmark? That's all we actually need right now and we definitely respect the refusal of the temporary residence. And also, what do you think is the next best action for us with our family reunification?

You can call the politi tomorrow. I heard they can give you a week extension :)

Okay, so the reason for the rejection is that you are not married but have tried to prove in vain that you have been cohabiting?

In that case, the only thing you can do to change this is to actually get married – or to actually cohabit in another country for at least 12-18 months before trying to move to Denmark again.

We did, and their advice was to get married tomorrow, lol. They can't give me an extra week though. 🙁

Marriage defeats our purpose of applying under cohabitation. Other option is to live together in 1 country for 18 months, making sure my partner changed his address this time in the Danish system. We have bad options, unfortunately. All we really want is just a week extension to leave Denmark since they informed us 9 days late. We really need help if anyone knows who we can talk to about the extension. :/

Your extension won't occur. Only Udlændingestyrelsen or Udlændingenævnet can do that. The first won't and the second won't answer in time - assuming you have a convincing argument to support your extension. I have been through this myself and I know, it sucks.

My suggestion is: leave the Schengen area as soon as you can or you will have complications in case you want to apply in the near future. If your plane, for some reason delay and you can't leave the EU area up to the deadline, you'll be considered illegal.
