No, because it has only one entrance. You comply with the other requirements, which are the size of the apartment (if it's >= 60 kvm) and the number of rooms. But you do not have your own entrance.

Do not apply while living there. Your case will be rejected. Get a new place.

I agree, you need to move.

In which area in Denmark do you wish to live? As you probably know, some areas are easier than others for accommodation.

I currently live in Aarhus, which is notoriously difficult to get a place  right now we live in city centre and we are trying to find some suburban places.

Are the housing requirements the same under both Danish and EU laws when applying for family reunification?

No, they are not the same. Under EU laws there are no other requirements than being able to register at an address. So if you use EU laws, you can move to another EU/EEA country for 3 months and then move back to your current address in Denmark and you won't have any problem then.

good to know :)

I also heard from a friend today that since the place I rent now is only on a verbal contract, me and the landlord cannot make a contract out of it. What do you think? Can we somehow make a contract that can be submitted to the immigration office? Hope I made myself clear.

If you move away for 3 months and then back to the same address, of course you can make a new contract once you move back.

I'm afraid you misunderstood me, I meant for the room we live in right now, can we somehow turn a verbal contract to a legally binding "paper" contract that can be used to apply for the family reunification?
Since it's difficult to get a place, we may have to apply using this address right away and then look for a place later...

You don't seem to understand. You CANNOT use the address where you currently live as a residence for an application under Danish laws. If you use that address, your application will be rejected and you waste a lot of money. Also, your wife will be deported and unable to obtain a new visa for Denmark.

She won't be able to acquire another short-term visa in the future if the family reunification is rejected?

Not if she has overstayed her current visa, then she might be fined and registered in the Schengen database as unable to obtain a new visa since she obviously doesn't meet the housing requirements and this should be self-obvious.

You really need to read the small print of the laws BEFORE you even consider to apply.

Your options now are:

If you want to apply under Danish laws, you need to obtain a new place to live BEFORE you apply.

If you want to apply under EU laws, you need to move away to another EU/EEA country for 3 months before you return to Denmark.

Otherwise, your wife can simply return to her own country before her current visa expires. That will buy you more time to settle everything.

Thank you for the thorough answer. We were trying to apply so she doesn't have to go home upon visa expiring (separating 3 months is painful), but now we will consider the option of her going home.

if my wife goes home before her family visa expires, does she have to wait for 3 months to apply for a tourist visa?
-And if she is on a tourist visa can we apply for the family reunification here in DK?

Yes, you can max stay 90 days for every period of 180 days.

You can apply for a residence permit either outside of Denmark or while visiting Denmark while here legally (max 90 days if on a visa or visa free).
