Danish citizen, unemployed & on A-kasse, can we get family reunification?

Hi All,

My wife came to visit me a few weeks ago with a family visit visa for 3 months, now we are planning to apply for the family reunification for her.

I'm a naturalised danish citizen since 6 months ago; I got my masters' degree last year in autumn and since then I've been job seeking. My question is: does unemployment and on a-kasse an automatic rejection on the family reunification? how large should our residential place be in order to fulfil the requirements?

Any suggestions, tips & advises would be helpful.

Yes, a-kasse is enough income. As long as you are only 2 persons, a studio-apartment (one room/2 persons) is enough.

This doesn't add up obviously you now need a 408000 yearly income even though the website state that you are refused if on "kontanthjælp" but NOT refused if you receive money from "A-Kassen"

Akasse and kontanthjælp are two different things, akasse is way better than kontanthjælp.

Now it's only been one month since my wife got here, should we apply as soon as possible or apply later(maybe two months and half later)? Is there any difference?

You should apply now, and you definitely MUST apply before her turist visa/ 90 visa free days expire.

I heard somebody saying it is still possible for my wife to apply for some kind of accompanying visa? Do you know something about this?

If your wife is already here on a visa, she doesn't need any new visa. What she needs in order to remain in Denmark is to hand in an application for a residence permit while her visa is still valid.

Thanks. What I meant is right now does she only have one option that is to apply for the family reunification? Can she apply for other types of residence permits?

The reason I'm asking this is because right now I'm job-seeking and there is a possibility that I might work abroad. If this happens, what will happen to her family reunification visa (if she gets it later in the future)? Does it get revoked?

Yes, if you move apart, or if you both leave the country, it would be revoked.

If you want her to get a residence permit for other reasons than being married to you, options could be a student visa or a work permit if she qualifies for it.

If you move to another EU/EEA country, it's quite straightforward to get a residence permit there, though.

Thanks Skaanebo. I have another question regarding the family reunification form (FA1), in the residence part it says we should include an rental contract, the thing is me and my wife currently living together with my landlord, we have our own room and the landlord has his. The landlord is a good friend of mine so we only discussed but did not make any written contract, it was more of an oral contract. Now the question is how can we make a formal contract if we want to? Do we need to follow some kind of formulation?

P.s. I just called the immigration office and a lady told me as long as we are living together with the landlord in an apartment, it does not qualify the housing requirement. Is it true?

Which department of the "immigration office" did you call? Statsforvaltningen handles applications under EU laws, Udlændingestyrelsen those under Danish laws.

Receptionists are usually not aware of the requirements under EU laws.

For national laws requirement, look it up under nyidanmark.dk.

In any case, if you need to make up a new contract, you can try to google it, or if you a member of Lejernes LO, you con contact this organisation to get a copy. You might also try some paper shop that sells these kind of standard formula papers.

Thanks again. We called Udlændingestyrelsen because I'm Danish and my wife is Chinese, so I believe we should applying under the danish law.
We did look up on nyidanmark.dk (https://www.nyidanmark.dk/en-us/coming_ ... rement.htm), in which it mentioned "the housing requirement can be met even though your spouse/partner in Denmark owns or rents the residence together with one or more people. Normally, the portion of the residence occupied by your spouse/partner needs to appear as an independent residence. " I don't quiet get what it means that a place "appear as an independent resident"...

It means you need to have your own front door. A house with at least two separate entrances. A house which is clearly divided.

I'm quite confused with the whole issue at this point, so I think it's better to describe it plainly.
The place we live I believe is lejlighed, which is about 50-60 square meters maximum. It contains two rooms, a kitchen and a bathroom. My address is under my place but only my roommate/landlord's name appears on the front door, therefore my address has a "C/O" . The place looks like below:

Like shown in the image, we live a one of the rooms and the landlord live in another. Does this appear to be okay with the rules?
