Hello marriage without borders.
My name is Jorge Alarcon, i have asked some questions before about this topic.
I am in a relationship with a danish girl name Mette for almost 3 years now. We have travel back and forward to visit. We are tired of doing this and we want to start our life together and be able to have a normal relationship without distance.
I have read all the consulting area on this website but i have some doubts.
I have read that we could stay in Sweden for some time and then go back to Denmark so my girlfriend can apply for family reunification under EU RULES and exercise her right of free movement in that way she is able to take her spouse back with her.
My questions are:
1. Once we are in Sweden, do we have to go to Denmark so we can apply for family reunification under Eu rules due to her right of free movement? or we have to stay in Sweden during the whole process.
2. Were do we need to marry in order for the marriage to be legal and valid for Denmark? As we don't know if we should get marry in Sweden or back in my home country Ecuador.
3. Once we are married would it be enough for me to have a tourist visa so Mette can apply for her right to free movement under EU rules, so we can go to Denmark? I was reading something in New to Denmark and i am not sure if i am getting it right but the exact paragraph says:
"A family member, including a foreign spouse/permanent cohabitant, is not required to have had previous lawful residence in the EU/EEA Member State or Switzerland in which the Danish national has exercised his/her right of residence so far."
Does this mean after we appply, even if my tourist visa time is over, am i still alowed to stay with my spouse until we get the residence permit?
It will help us so much to clear our minds on this doubts since we are specting to start with the process at the beginning of 2017. We will be forever grateful to you.
