Waiting for my residence perimit.

Hello .

My wife and I used the swedish solution and I have been waiting for my residence permit for quite some time now. We already live in Denmark but I have a question to ask and I hope you can answer it. I have a business meeting in Berlin at the end of the month. Am I allowed to go to Berlin when my residence card is still on process ?

I hope you can help me with this. Thank you.

Yes but only if you have a valid visa or a valid residence card from another EU-country than Denmark.

I have the swedish residence card wich I got when I was living there with mi wife. Is that good enough to go to Berlin?

Yes you can travel on your Swedish residence card provided it's still valid and haven't been retracted by the Swedish Migration Board. This might happen if you have been living outside Sweden for more than 6 months but you should be notified beforehand (though with a letter sent to your registered address in Sweden so if you didn't sign up for a forwarding letter service obviously you won't know).

Anyways if it's less than 6 months ago you moved from Sweden, it will still be valid.

Also I seriously dought, that a german official with go through a tedious procedure to investigate, if a residence card has been nullified by the other EU-country, which issued it, unless he has a very strong reason to expect, that something is wrong with the person showing it to him.

There are plenty of illegal immigrants in the EU as well as failed asylum seekers refusing to go home. So spouses of EU-citizens, who have already had their right to reside in the EU confirmed by authorities in an EU-country, are hardly at the centre of interest for police and other authorities involved in immigration control in the EU.

So in short showing the residence card along with your passport should have almost the same effect as showing an EU-passport which is "ok next please"
