Goodag dag allesammen,

Undskyld hvis jeg kan ikke skrive perfekt dansk, men fordi jeg har skrevet min sagen paa engelsk i mange dage siden men ingen svar

Jeg vil gerne sporge om kan man tage invandringsproven eksamen hvis man bestaet provedansk 3?

Jeg er i thailand nu ( jeg blev smidt ud af danmark) fordi jeg er ikke bor sammen med min x mand ( paa grund af skilsmisse) og skilsmisse vil blive et ar i januar maned 2011 og statsforvaltning sagde at hvis min xmand er stadigvaek ikke enig skal det i retten og vil tage 4-5 maneder er det rigtigt??? Jeg troede at det blive automatisk skilt efter et ars separation....

Nu, planner vi at sog om turist visum pga afslutning af min skilsmisse , er der muligheder for det? faa jeg visum?

Haaber at I forstaar hvad jeg mener og jeg beklager for min dansk.

It appears from what you write that you are not divorced, you are separated. According to Danish law generally you have to be separated first, then after 6 months you can be divorced if both parties want to. Divorce does NOT happen automatically, the parties will have to apply to Statsforvaltningen for divorce.

If only one of the parties want the divorce, that party has to wait until 12 months after the date of the separation. Then the party who wants divorce has to apply to Statsforvaltningen, and if the other party still will not consent, the first party has to apply to the court for divorce. You cannot apply directly to the court. You can apply to Statsforvaltningen, even though you are not living in Denmark.

The test is not only language, you will also be tested for your knowledge of Denmark (history, political system etc.)

Yes, I was separated since January of 2010 then in July 2010 I applied for the divorce but my xmand was not enig. Therefore I will try to apply for a divorce this coming January 2011. If my xmand do not agree for the divorce after 1 year If I need to apply to the court ikk? who will show up at the court in Denmark? If I am not there what will be the case would be? Do I have the possiblities to win the case?

My questions are:

1. I want to travel to Denmark as tourist on February of 2011 to wait for my divorce and get married with my new boyfriend do you think they will give me a tourist visa?

2. My boyfriend has a 15 year old son living with him, do he need to make a bankgaranti of 124.000,00 for my tourist visa? (I had been to Denmark as tourist 2 gange September 2005 and April of 2007) .

For divorce you must apply to Statsforvaltningen first - as I wrote you cannot apply directly to the court. Statsforvaltningen will then contact your husband for his consent. If he will still not give it, you must actively demand that the case be referred to the court. Statsforvaltningen will do that. You do not need to be present yourself, you may hire a lawyer to represent you in court. When you have been separated 12 months you have a RIGHT to get divorced. The only thing your lawyer will have to show in court is proof that you were separated January xx 2010, and that you and your husband has been living apart since then. In your case this is no problem. Also it is no problem if you could not leave your husband on exactly the day you separated. The authorities accept that people who separate may need several weeks to arrange to move.

As for your chances for getting a visa, it depends on whether you overstayed your former permit. If it says in the letter you got from Udlændingestyrelsen that you have been banned from entering Denmark for a certain period, then you will not get visa.
If it just says that your residence permit has been annulled, and that you have to leave on a certain date - and you did that - then you would have a reasonable chance of getting visa. Your boyfriend will need to send you an invitation (there is a form on www.nyidanmark.dk), and state that he will 'house and feed you' during your stay. The authorities MAY demand that your boyfriend further guarantees for you by depositing about 60.000 kr. in the bank. The 124.000 kr. is the amount needed when someone is applying for reunion with a spouse.

Please note that you as a tourist do not need to pass any language or other test. That will only be necessary if you get married to your boyfriend and apply for residence permit.

1. I was "udvist" in November 2010 . As of this moment I am not working, no assets. Do you think they will give me a visa? I will pay the planetickets and my boyfriend will shoulder the rest.

2. When I was still in DK my BF already made an Invitation and I have it now. is it ok it doest send via post or email?

If you are going to pay for the visit yourself, the requirement is 450 DKK pr. day of intended visit. So 15.000 DKK is enough for about 1 month. The easier solution however is, that the person inviting you (your fiancée / boyfriend) sign, that he will be the one to cover all your expenses. Then usually no more questions are asked.

Please fill out the invitation form as well as the application form in cooperation with your fiancée / boyfriend, so that you are sure, that the information given in the two forms are identical. Most often it is the person living in Denmark, who do most of the paperwork and just leave if to his girlfriend / fiancée to sign the application form and hand in the application at the danish embassy.
