Family Reunification Under EU Law (Lengthy Process)

Hello Supporters !

Well as the subject describes itself, since the question mark ? is hovering over my head, i'm desperate to understand why is it taking too long for Statsforvaltningen to take a decision on my case.

Which is that i'm married to a Danish Woman in Spain, got my EU Resident Card from Spain obviously , came back to Denmark applied for a Family Reunification under EU Law on the 1st of May 2014 til now which is 4 and half months, and they are mentioning they have too many cases to work on.

I may apologize for not coming to the point! the query is :- Where can i whinge (Complain) i need help am going insane here for not knowing what to do where to go and seek help, is that too much to ask..

My case is very simple. A Foreign Dual national guy married to a Danish girl, holding my Spanish Permit, submitted all the proves from Spain e.g. Bank statement, Lease contract, etc....

The bottom line : You Gentlefolks out there ! Kindly help me out and in case you want to reach me to explain this chaotic concern of mine i'm willing to give my number: - 71 42 12 44..

The EU law stipulates the authorities have six months to issue a residence card so you have no reason to complain yet.

It depends on whether the Danish citizen is working, studying, being a pensioner or is self-sufficient in the other EU country.

If the Dane works in the country of residence, 3 months will suffice. Otherwise, 6 months is a safer bet.

Which country does your wife come from? If she is from another EU country than Denmark, you can apply right away and it doesn't matter if she studies in Esbjerg or Copenhagen.

After you move to Malmø, your Danish wife must go get herself registered. Once she is registered, you can apply for at EU-residence card.

You can also apply for a residence permit according to Swedish rules. One does not exclude the other.

You ought to get your EU-card within 6 months, but will most likely not (most people don't), but you have the right to stay whether you get it or not, if your wife fulfills the few requirements to be an EU-citizen enjoying her right of free movement.

For an answer to the application for Swedish residence PERMIT the waiting time is app. one year.

You will need the same documents for both applications, so make two sets of copies.

You don't have to worry about the Danish paperwork just yet. You must first establish a 'real residence' in Sweden. Since your wife will be studying in Denmark, you must be prepared to stay in Sweden about 6 months in order to prove the 'real residence'. Your wife MUST keep all documentation for her commute between DK and Sweden, rent should be paid through the bank (for documentation), shopping should be done with credit- or debit card (for documentation) and of course mainly be done i Sweden.

After you have lived AT LEAST 3 months in Sweden you may apply for a Danish EU-card, attaching the above mentioned documentation. It is advisable to wait until you have stayed close to 6 months, though. You will get a so-called 'pre-approval' and with it you can move to DK and you then go to 'Statsforvaltningen' to apply for the EU-card.
