What can be problems?

if stay in Eu efter limit of 90days stay(visit visa to family)??this can be ban to eu or fine? does anybody had experienced for this situation??

Yes, it can result in a ban and a fine. Mind you, if you are here to stay, you can apply for a residence card under EU laws and then it won't have any effect at all that you have overstayed your visa as long as you fulfil the requirements.

It can only be a problem if you intend to return to your own country and do not wish to move together with your spouse to a country in the EU/EEA.

Or if you have applied for a residence permit or a residence card and don't fulfil the requirements. Then you have been staying illegally all the time after the expiry of your visa.

Question Skaanebo;

I don't want to confuse anyone, but I was under the assumption, that it wouldn't have any sanctions/consequences, if you applied for a residence card for your spouse (EU-rules), and she therefore obviously would overstay the visa, while waiting for a response (6 months). I believe you told me in another thread that such an incident would never carry any sanctions and she would instead just be denied and told to leave the country. If the situation had changed so the ground for rejection would now be fulfilled, then it was possible to re-apply. But No ban, no fine, no penalty?

But in this thread you say pretty much the opposite; that if it turns out the requirements weren't actually met, (example: the requirement for the EU citizen to be considered self sufficient), despite thinking they were when applying, one may risk a penalty ban/fine for overstaying the visa, even when applying according to the EU-rules? :shock:

Overstaying will only be a problem if you wish to leave the EU/EEA without having obtained a residence card. So if you give up applying because you don’t fulfil the requirements, then your stay has been illegal and you face the risk of a fine or a ban.

If you succeed in obtaining a residence card, no matter if you apply once or twice, obviously there is no problem then.

Ok, glad you cleared that up :-) It was the last sentence you wrote, which confused me, as it seemed independant of the one you wrote above. My bad. I'm not really that concerned, but it's good to have it out of the way. Thank you.

But what if the scenario is as follows: You apply for the residence card but is rejected after 6 months. You decide to follow the instructions of leaving the country because the circumstances couldn't be changed fast enough to fulfill the requirements before the set departure date, and you don't want to cause any trouble. You plan on re-applying at a later date, when the requirements will be fulfilled. In this scenario, that would be either by applying for a new visa first based on the requirements being fulfilled this time or instead applying from abroad, as you did follow the instructions to leave.

Would a person in such a scenario risk a ban and/or fine?

If you have been staying longer than the validity of your visa and you decide to leave the country for whatever reasons, your stay above the validity of your visa has been illegal and you risk the consequences: fine and/or being banned from entering the Schengen area again in a forseeable future.

One should never apply for a residence permit or residence card and remain in the country after the expiry of one's visa unless one is 100 percent certain to fulfil the requirements. If in doubt, apply from your home country instead.

If we were to apply from her home country, would that mean she'd need to get a private health insurance prior to applying. She wouldn't really need it until after we got a response after 6 months? I believe she need to be here in the country with me, before we can apply for health insurance through Denmark, as I work there. I live in Sweden.

Would another option be for her to join me in Sweden on a visa, apply personally and stay for the duration of the visa. Before the visa expires, leave the country and wait in her home country for the verdict? Would that be doable without any risk at all? and would she be able to travel back to Sweden immediately thereafter?

Ultimately I do believe Ì fulfill the requirement for having "sufficient funds to support us", but there is always a risk that they do not think so..! and for her to receive a ban would be devastating!! In the case that it actually did happen they reject it while she is in the country, and they forced her to leave and issue a ban at the same time.. Would she be able to re-apply from her home country afterwards.. and actually allowed to travel back if the application for residence card was approved? or would she be forced to wait until the ban expired after x-years?

EU laws overrule any travel ban as long as it is not given by reason of security or public order or health.

You fail to explain what your ultimate goal would be. Do you wish to live happily ever after in Sweden? Or do you wish to move on to Denmark after staying in Sweden?

If the latter is your ultimate goal there is no need for a Swedish residence card to be issued in the first place. You simply move to Denmark once the Danish spouse has lived for a minimum of 3 months in Sweden. If the Dane also happens to work in Denmark, there is no doubt of the outcome of a Danish residence card being issued.

Hej Skaanebo,

Jeg skriver lige på dansk, holdte det på engelsk fordi det var den engelske del af forumet (meget undskylde hvis det skulle være holdt i engelsk stadig!).

Ultimative mål: Rejse til Danmark og bo der. Sverige er kun 'vejen' dertil og egentlig også en "plan b" i tilfælde af Danmark gav afslag. Men Danmark er målet og det vi absolut vil!

Når min kone kommer til Sverige har jeg, som danskeren, boet her i Sverige i 7 måneder for mig selv. Hun kommer først til August. Jeg arbejder fuldtid i Danmark og det vil jeg også stadig gøre efter vi er rejst til Danmark. Det samme arbejde. Det er mig, som også tidligere har spurgt ind til det at have tilstrækkelige midler i Sverige, i en anden tråd, fordi jeg var bange for om jeg lå højt nok over risikonormen.

Efter de råd vi har fået, var vores plan at søge her i Sverige først, dernæst Danmark. Vi ville bliver i Sverige og vente på en 'forhåndsgodkendelse' fra Danmark, og måske få opholdskort i Sverige inden Danmark når at svare. Det er den eneste grund til, at vi ville søge her i Sverige først og blive her i mens, simpelthen af frygt for at Danmark afviser os efter vi er flyttet dertil og vi så står i en rigtig dårlig og utryg situation.

Men det er i Danmark, vi vil bo.

Men så er der jo heller ikke noget at bekymre sig om.

Dansk opholdskort vil blive udstedt, når blot du kan bevise, at I vitterligt bor og opholder jer i Sverige. Og så er det jo ligegyldigt, om et svensk kort bliver udstedt eller ej.

Bare sådan uden videre? :shock: jeg skal blot bevise vi bor og opholder os i Sverige? Så burde chancen for at ja da være forholdsvist høj, i det jeg har rent mel i posen og reelt bor her og vil de næste mange måneder. Min kone vil også nå at bo her i op til 6 måneder, hvis vi bliver og venter på svar.

Er jeg ikke stadig pålagt at skulle bevise for Danmark, at jeg har haft tilstrækkelige midler, mens jeg bor i Sverige, i det jeg arbejder i Danmark. Efter jeg kommer til Danmark, ved jeg godt at jeg vil kunne blive betragtet som arbejdstager derefter, da jeg har arbejde fra dag 1 i Danmark (hvis jeg ikke har misforstået noget).

Vil du give mig ret i, at vi stadig er bedst stillet ved at blive boende i Sverige, mens vi søger i begge lande. Planen er at søge i Sverige først, så jeg kan fremvise kvitteringen i Danmark (som du faktisk foreslog, og er en rigtig god ide).

Og du har helt ret, såfremt vi får det danske, er det ligegyldigt om vi får det svenske eller ej! :P

Når I søger om forhåndsgodkendelse i DK, er det jo bare at blive boende i Sverige, indtil I får brev om, at I kan flytte til DK. Og ja, det er ikke svært overhovedet.

Det er jeg utrolig glad for, at høre dig sige! Jeg havde forstået det som vanskeligere end blot at reelt og faktisk have boet i Sverige - som fx stadig at skulle opfylde krav om tilstrækkelige midler i Sverige derudover, selv ved ansøgningen i Danmark! :shock: :oops:

Dumt spørgsmål: Hvis nu Danmark godkender først, og Sverige bagefter, så kan den svenske godkendelse vel ikke annullere den danske, i det det udstedes senest?
