Hello,

I am 21 years old and from Canada. My boyfriend who will be 23 in 1 month is Danish. We have been together officially for 3 years. From September of 2010 to September of 2011 I was here on a 'working holiday visa'. Right now, I am here (in Denmark) just on a 3 month tourist visa, I have been in contact with a family in regards to an aupair job. I understand that it is legal for me to apply for the visa while I am in Denmark, however my question is this; Am I able to obtain an Aupair Visa if I have previously had a Working Holiday Visa?

Any answers or information would be extremely helpful.

As a general rule you should apply from your home country. However, as an exception you may be allowed to apply, and even get an au pair residence permit. But it is also possible that you will be told to go home and apply from there.

NORMALLY you cannot get an au pair permit, if you have had residence permit before. You can apply and learn whether you for some reason or other will be granted au pair permit.

And be aware that an au pair residense will afterwards give you 5 years visa quarantine to Denmark, when you apply from Denmark. And that the quarantine is given even if your application is denied.

It is considered a misuse of visa to apply for a residence permit (which Au pair is), while being in the country on a visa. There are exceptions, but au-pair is not one of those.

So it is the applying part that is considered a misuse. If you get the residence permit or not does not influence this. It is only applying for a visa that is quarantined. You can apply for other kind of residence permits in those 5 years, like family reunification.

@ soreng, Canadians don't need visa to come to DK. Are you sure the quarantine applies to people who can enter DK without visa?

The quarantine applies to all visas.

It is correct that you as a canadian can enter schengen on the normal "not more that 90 days over a 6 month period" visa-less method, but if you want to exceed that you will need a visa also as a canadian. So that rule can most definitely influence also a canadian.

I mentioned this rule with the quarantine as a service so that the descision can be made on the grounds of facts, and that she does not stand in 4 years needing a visa, and are surprised to get denied.

I just find it usefull information that always should be mentioned when people ask about applying for au pair from denmark.

If I am quarentined for submitting my application in Denmark, does that mean I am unable to enter Denmark even for a visa-free stay (90 days out of 180 days)? Or does it simply mean I would be unable to, for example, apply for a working visa?

You can offcourse enter Denmark if you do not need to apply for a visa to do it. And don't get visa confused with residence permit that can be given for work in your example. You can still apply for residence permits as they are different from visas.

Because of the canadian citizenship a visa quarantine is not a relevant worry in this case. However many others have fallen into that trap before, so for the benefit of other readers, it is relevant to mention it for their sake.

Still, even though there might not be any or much risk involved in applying for an au-pair visa for Erika, I very much dought, that it will be granted, when she has already had a working holiday visa, since this (officially at least) serve the same purpose of cultural exchange.

So in short Erika and her boyfriend might want to consider other options instead such as applying for a study visa or perhaps moving to Sweden or another EU-country, if they like to stay together without waiting for the 24 year birthday of Erika.
