Malmo to Copenhagen commute question

Hey all,

First time poster, long time admirer!

My and my partner have recently done the move to Malmo from Copenhagen to do the whole marriage in Sweden = acceptance in EU (therefore Denmark) thing. We are very happy here and got married last Saturday. My first point of call was the Malmo Migration and Skat control to sort out my papers. Of course with these kinds of things you have to wait obligatory 4-6 weeks blah blah blah. But I have a case pending and a receipt for said case.

Which brings me to the question: As I am unable to work/live in Denmark and the fact that I am allowed to be here in Sweden (stated by the powers that be), although my case is pending however, will I be deported if caught in transit between Malmo and Copenhagen?

Noting that if I were to present my 'pending case receipt' to authorities would this hold up as legitimate?

You can only cross the border to Denmark from Sweden if you have a valid schengen residence permit or a valid schengen visa.

So if you had a Danish residence permit before but it has been expired or annulled already or if your visa has expired and you still haven't received a Swedish residence card you are not allowed to cross the border and if you get caught in Denmark as an illegal, in worst case you could get fined and deported back to your home country rather than back to sweden.

So it's not advisable to cross any schengen border unless you have your papers in order.

The "worst case" is really only that: a worst case.

But skaanebo is right: your pending case reciept does not expect you from the demand of being in possession of a valid schengen visa or a valid residence permit / residence card from a Schengen state, if you travel to any other schengencountries than Sweden, even if it is just for a day trip. With your pending case receipt you can stay legally in Sweden but only there.

And if you leave Schengen completely, you can also not enter Sweden again with your pending case reciept. Even for the purpose of entering Sweden from a non-schengen country, you will need one of the above mentioned things. Or a nationally limited swedish visa, which can then be issued by the swedish embassy in the non-schengen country, which you are visiting.
