Hello there I would like to seek advice from this forum... Me my girlfriend and son just moved to malmø and would like to know the next step we need to take... my girldfriend just applied for the opholds kort together with the baby... the problem is that my permit has expired and hence here illegally for now... I would like to know if we can get married now without me having the permit or to apply for sambo or to apply for assylum then the resident permit.. I would like to know what step to take... Thank you very much...

In order for you to have a right of residence after EU-rules, you will need to either be married or be able to prove, that you have resided at the same adress for the last 18 month or so. So if you cannot prove this, the next step is to get married. When you are married, you should apply for a residence card at Migrationsverket.
I presume, that your spouse is a danish citizen. And in that case your spouse and child have not applied for residence card. They have rather let themselfes register at the civil register in Sweden at Skatteverket. You will need to do that also eventually, but first you must get married and apply for a residence card, because you are presumably a 3. country (non-EU) national.
