Hi everyone,
I am living illegal in Denmark for almost 2 yrs now, but i am married with a danish man but then we did not process some legal papers for me because that time when we got married he have no job yet and no apartment.. Right now, he have job and just bought a 2 room apartment in Malmø. Is it possible for me to go to Sweden and process legal papers even if i am living illegal in Denmark? What should we do with this case? I hope someone can answer my question..

Yes it is possible, but you might be given a fine or other punishment for your illegal stay in Denmark. Your husband should simply follow the guidelines given on this homepage under "jeg vil... flytte til Sverige/EU-land".

We already went to the swedish embassy in dk but they did not gave me a visa so i can go to sweden legally they said i need to go home where i came from so i can can process my papers there.. They gave me the papers i need to fill up and then pass it in the swedish embassy in my country.. My question is:
a. Is it a good idea to go home?
b. How many months will it take to process those papers?

In principle you may not travel to Sweden. In practice you may very well be able to.

If you take the chance to go to Sweden with your husband, there will be no problems once you are there, because according to the EU-rules you have a right to be there with him, even if you entered Sweden illegally.

The problem is that you may be 'caught' by the border police. If you are ready to move NOW there is a good chance that it will not happen. If you wait a few weeks most likely Denmark will have introduced checkpoints and you will almost certainly be prevented from entering Sweden.

Whether it is a good idea to take the chance is entirely up to you.

If you go home you can apply for a visa to Sweden to join your EU-citizen spouse immediately and in spite of your having stayed illegally in DK you will have a right to such a visa. It should not take more than at most a month to get it, and it is free. If you choose to do this make sure that you fill in your application correctly. What if i will go in sweden now, what should i do when i get there? how can i get those papers i need?

Once you hand in your application for a residence card at the Swedish migration board your illegal status is immediately turned into having a legal residence and you may for instance start work in Sweden immediately.

The advice you received at the Swedish embassy is in regards to obtaining a residence permit under national Swedish law. It has nothing to do with EU rules which work as a parallel set of rules and can be used in your case if your Danish spouse moves to another member state.

So forget about that advice unless you really intend to stay in Sweden for a long while and wish to come under the pair of rules governed by national swedish law.

Instead just opt to apply by EU law by moving with your Danish spouse to Sweden. Coming from Denmark to Sweden you may encounter Swedish customs patrolling the border but there is no border police. Some media hype on this issue in Denmark right now but I wouldn't worry about it if I were you. Danish police so far has only taken an interest in patrolling the border and asking for valid ID for people traveling into Denmark and not for those leaving on the border to Sweden.

Well first of all, you can of course not move to Sweden, before your spouse has settled there. When he have done that, you need to go to Migrationsverket and Skatteverket and fill out some papers. And thats basically all. Skaanebo has already explained the rest.

I guess it will depend on the status of your Danish spouse if you can get a Swedish personal number before you got the residence card.

If your spouse is working in Sweden it should be straight forward. But if your spouse is working in Denmark and just living in Sweden it may be a little more complicated.

Is there any special reason you would need to get a Swedish personal number so quickly? You can get it for sure once you got your residence card.
