Processuel ophold or not

I was working in Denmark for 14 month from oct 2009 til November 2010. I have received a letter in february 2011 that I have to leave the country by 20.01.2011, so I received it after the date I had to leave the country. I am romanian. The decision was made in 20.12.2010. It took quite a long time to get to me. I made a complain about this decision and I received a letter from udlændingeservice , saying that I am allowed to stay in Denmark until they reach a final decision and it can take up to 6 months to receive it.

I am not really sure what does it mean that I am allowed to stay in Denmark. As a tourist I can stay with or without their letter. At borger service it shows that I am out of the country since I do not have a resident permit and they took my yellow card(I am no longer covered by danish health service according to my doctor). I received kontanthjaelp for one month until 20.01.2011 but now they said they can't pay it because they don't know if I have processuelt ophold or not. I am unable to get a job because of an work accident I had in September and I will be operated soon on my own expense since I am no longer insured in DK.(that is what doctors and officers from borger service keep on telling me even if my accident was while I was working in denmark. The doctor misdiagnosed me and they realized that I require a surgical operation only after my residence permit was taken away).

I am open to any suggestions or opinions you might have.

You are in need of legal advice, and your case actually does not belong under what 'ægteskab uden grænser' is about.

Yes you should seek qualified legal advice about that case. From your describtion it seems like an erroneous decision, since as EU-citizen you should retain your status as worker and your right to residence in Denmark in the described situation.

But to give a qualified feedback on such a decision, one really need to reed the decision itself and not just a resume of the case, as you have given here. And as this is not a case involving binational cupples and their situation, which is the area of interest and expertise for ÆUG, please contact the "retshjælp" (legal assistance), which mh has given you a link to.
