More immigration tightening -what does it imply for EU-rules

Reading today that, once again, they are tightening the national immigration laws. I know that normally this does not and cannot modify the basic EU-rules, but sometimes they do change little aspects of it (like getting free danish courses and employer training).

Do the newly passed laws affect positively or negatively in any way those that are here as residents because of family reunification under EU-law?

No, it does not have any impact on EU-regulations this time at all. But I have been considering to write about the new Danish regulation in English here, so forengers who is not so good in Danish can understand what it is all about.

* There will be a new application fee worth around 6.000 kroner.
* The foreign spouse need a certain amount of points for education, business knowledge and language capability. The parties behind the deal still negotiate on the exact content of the demand of points.
* The 24 years demand will be deleted in its current form. Are you or your partner below 24 years of age, you need greater amount of points than others.
* The banking guarantee amount will be risen from now 62.231 kroner to 124.462 kroner.
* The connection demand will be tightened, so the foreign partner need to make several visits on visa and participate in a language course. We still do not know the exact content of this demand.
* Is the one who already lives here not a Danish national, he/she has to fullfill the new demands in accordance with permanent residence permit (100 points), Even if he/she got permanent residence permit before the new demand were made. It is yet not known whether there will be maked stronger demands to Danish nationals, who wants unification with their spouse or children from other countries.
* The one who lives here may not have got a prison penalty for a certain time before unification.

Remark, that all the "old" demands is still in action. Danish National Party (Dansk Folkeparti) is very proud, that Denmark now have the most tight immigration act in Europe and therefore is calling Denmark a "frontstepper".

We are now several people here, who guides on the unification rules - both national rules and EU-rules - and we strongly recommend everyone who has the ability to apply for unification according EU-rules. We believe, that the national rules are now so tight, that only 1 or 2 per cent will be granted according national rules.

The secretary of Integration, Birthe Rønn Hornbech, has said to the press, that if you have been to one the 20 best universities in the world and has a language degree from there, then you have a good chance. And she has revealed, that business knowledge is to be understood as a high-educated job with top salary.

And so on. So, as you can now see, only Bill Gates and guys like him will be able to crawl thru the needle eye......

120 POINTS for PhD/candidate education in Denmark or top 20 university

80 POINTS for PhD/candidate education from other universities abroad

70 POINTS for Bachelor in Denmark or top 20 university

50 POINTS for Bachelor from other universities abroad

50 POINTS for Business academy- and profession bachelor in Denmark

40 POINTS for businessacademy- og profession bachelor from abroad

II/ Business experience

80 POINTS for Qualified business experience (positive list job) 2 years in Denmark

60 POINTS for Qualified business experience (positive list job) 2½ years of the last 3 years in abroad

40 POINTS for Other business experience 2½ years of the last 3 years in abroad

III/ Language skills

50 POINTS for Danish, Swedish or Norwegian on level equal to education test (C 1)

40 POINTS for English, German, French, Spanish on level equal to education test (C 1)

IV/ Others

20 POINTS for Danish language on level equal to test in Dansk 2 (B1-B2)

20 POINTS for English, German, French, Spanish on level equal to test in Dansk 2 (B1-B2)

20 POINTS for If the applicant do not settle in a ghetto area

10 POINTS for Active participation in global humanitarian organizations

10 POINTS for Self support (cannot be combined with business experience)

You can achieve points with qualification demands from group I-III. You can add up to 20 points from group IV.
