Help please

Hi guys

I submitted my application for permanent residence 3 months ago and it says it should be processed within 3 months but I don't see anything happening in my application progress in nydenmark page. So the question is if they wait until my 5 years are over and reject since I applied little more than 2 months of my 5 years can I still apply for the permanent residence?

What I mean is if your residence card expires can you still apply for permanent residence based on EU since I read somewhere you automatically get permanent residence after 5 years and applying for it is only for the matter of the paper.

If you are under EU laws, you do not apply for a “permit”. Your rights are not dependent on any kind of government documents. You have all your rights from the moment you applied for a residence card.

Yes, the deadline is 90 days but they have a quite big backlog at the moment. That’s why they are taking so long to work on your case. Just be patient and you’ll get your answer in one month or two. You can also call them and put some pressure, saying the 90 days are over and you haven’t heard from them yet. Try sending a message to the person with your case in the case details page.

Thanks for the replies. I am not sure what to do as I am sure it will take time but if they answer after my residence card expires will be able to apply again for the PR card? Say if they reject saying I applied too early? Or will they say you have to go back and apply from your country?

Also can I work while my application is being processed?

Ansøgere, der er tredjelandsstatsborgere, har alene ret til at arbejde under ansøgningens behandling, såfremt betingelserne for ophold efter EU- opholdsbekendtgørelsen er opfyldt. I visse tilfælde kan der blive tale om strafansvar for ulovligt arbejde, hvis sagsbehandlingen viser, at ansøgeren ikke opfylder betingelserne for lovligt ophold i Danmark.

And how can you meet eu residence requirements?

Again, you worry for no reason. You have all rights from the moment you applied. Your rights do not depend on a new residence card being issued. So it doesn’t matter if you get it before your current one expires. You can continue to work, no matter if you get a new one or not.

Hi thanks but my work place asked me to get new permit so I am wondering what will they do if my application takes a lot of time

They won't do anything. If they ask, you can simply show them the EU law text. You also ought to have got a receipt when you handed in your application for an extension.

Thanks for the reply. I was just concerned since I got divorced but satisfies the 3-year marriage with 1 year in DK. I am worried about that and also applying a few months early. But I hope one can still apply even if they reject and the residence card expires as I got an email saying that 90 days processing time will be more delayed. How long will they take to send some correspondence who knows
