Permenant residence
I been divorced and the marriage lasted 3 years and 1 year in DK.Soon my 5 year visa needs to renewed. Can I still apply for PR even thoo I am divorced? or do I get objection that I cannot get PR through EU since I am divorced? I have good job but can I also apply for other visa just incase and hold 2 visas, one on postive list?

Yes, you can. Submit proof of having been supporting yourself during all five years (your income statements from SKAT).
There is no ban on having two residence cards, so if you want, you may apply for the other too, but it would be an unnecessary expense.

Thanks for the reply. I am asking since when you apply for PR, it says it takes 6 months and during that process and if in case they make objections or deny. Can you apply for other visa while you got rejection?

The rules are very clear, so I don't see why you worry.
But if you want to 'wear belt and suspenders' as we say in Danish, you should apply for the residence permit according to the positive list now, as you need to do it while you have legal residence/stay, and IF you should get refused the EU-permanent card, you will for certain not be legally residing.

You are in two categories, which is absolutely OK. One is spouse of an EU-citizen, the other is former spouse with sufficient funds to support yourself and right to continued residence according to the EU-rules you have been informed about earlier.

You check the box for 'DIVORCED' and for 'SUFFICIENT FUNDS'.
The authorities have the information on according to which reason you got your original residence card.

Hello again
I have good job from last year that pays 524000 yearly so I applied for and based on my 9 years of stay combining eu and non eu stay.
But the form says only tick one and it mentions PR but doesn’t say sufficent funds as it was in other category so I checked divorce and ticked PR. I sent them my job contract, pay details as well as my cpr history to show I lived here for 9 years. But for pay slips I could not add as they opened up applying pr from contact form during coron and it has file limit. So hopefully they can check skat.
The directive says one can mix eu and non Stay when applying for pr, but is there a possibility of rejection if you apply before 5 years up like 2 months before?

You can apply ONE month before you fulfil the 5 year requirement.
Do not apply before, as you would be rejected and have to start over.

This part (last paragraph): "Efter dansk praksis skal en eventuel forudgående opholdsperiode med opholdstilladelse efter udlændingeloven medregnes i beregningen af 5-årsperioden, da der er tale om lovligt ophold, uanset om en del af det lovlige ophold er tilbagelagt i medfør af nationale regler, under forudsætning af, at ansøgeren i perioden med opholdstilladelse efter udlændingeloven, tillige opfyldte betingelserne for lovligt ophold efter EU-reglerne."
says that: According to Danish practice, provided that the applicant during a period of residence with permit pursuant to the Immigration Act fulfilled the conditions for legal residence in accordance with EU rules, a prior residence period with a residence permit under the Danish Immigration Act must be included in the calculation of the 5-year period, since it is a legal residence regardless of whether part of the legal residence has been completed under national rules.
So yes, they can be combined, but only if you during your residence with permit pursuant to the Immigration Act COULD have had EU-residence.
