I have been reading through this forum and am so grateful for it, there is so much good information here! I am an American girl who wants to move to Denmark to be with my Danish boyfriend. We are willing to get married because we have never lived together and can't fulfill the living together requirement and I am more than happy to marry him, it definitely wouldn't be for convenience. We have two things standing in our way. The main problem is that he received benefits from the system while unemployed, I know there are a couple of types of benefits and don't know the exact name, he described it as the bad one. The second thing standing in our way is that he lives in an apartment that he owns but it is small, one room, a kitchen and a bathroom. We can fix this one but the benefits thing is an issue. My boyfriend has a 17 year old son from a previous relationship who lives with his mother. My boyfriend sees him often and they travel to France once a year on vacation. Since the son is 17 they don't have any type of document showing that he is to see him any other weekend or anything formal. 17 Year old boys don't typically work this way. They are very close and probably see each other a minimum of four times per month. My question is, will dispensation work in this situation to waive the benefits issue? I can't find anything concrete on this, the new in Denmark site mentions it but it seems a little vague to me. I feel a little rushed by this because of his sons age, he will be 18 in just less than a year so we are on a time limit if we can use dispensation. My boyfriend just got a job as a finance manager but I don't think that will help our situation. I desperately want to be in Denmark with him and am very stressed over this. If anyone has any knowledge or prior experience in a similar situation I would really appreciate any help you can give me.

Is it possible for your boyfriend to move to one of the neighboring EU-countries after you get married, and commute to his job/work from home?

Since he just got a job that sounds well-paid, does he earn what would be a yearly income of DKK 408,800 ? (four hundred thousand eight eight hundred)

His employer will be able to give him the DISCO-08 code.

In the first case, you can use the EU-rules, in the two others he may be exempt from several of the usual conditions.

Thank you so much for getting back to me MH. He does have a positive list job. Will that eliminate the harder exemptions (prior benefits, not having lived together if we don't get married) or will that just make an exemption for the attachment rule? I know there is no guaranteed answer, but I'm hoping to see what is typical in these cases.

There are conditions:

You will have to be married OR show proof that you have been co-habiting for 18-24 months, so you do need to get married.

He must be able to provide for you, and neither of you will be able to receive any monetary benefits without you loosing your residence permit.

You will get a work-permit, and you may also study, BUT you will have to pay tuition and are not immediately eligible for the State scholarship (SU).

If you want to study/continue studies, look into whether there is any exchange program you may be eligible for, one that would make you exempt from paying tuition.

You do not need to have visited DK before, but since you as an US-citizen do not need a visa to enter DK, you may wait to apply until a few days after coming to DK.
