Hej
Can somebody guide me other visa option???
Applied for family reunification for my non Eu wife she got refusal and vi appealed decision. Refusal reason i have PR Less than 3 years (it 1.5 year now PR) we have 2 small kids born in dkk.
PR got( from statforvaltningen) on EU family member mean( Ex. relation).
Can i apply some other type visa for her(not student or positive list etc)

f.eks on children base visa...
Accompanying family members in Styrelsen for International Rekruttering og Integration,
or any option for visa in statforvaltningen on family base....

If you hold a residence and work permit, you can usually bring your family with you to Denmark.
but my visa status maybe different

I think wires got crossed here - in Danish, visa means the short-term permit to visit DK.

You want to know if and how your wife can apply for a resident permit.

While you have residence on basis of EU-rules, as far as I understand you yourself are not an EU-citizen, and cannot use the EU-rules for family reunification.

The rule you refer to does not apply either, otherwise you would be in a far better situation than Danish citizens ... It applies to those who get a temporary residence permit, based on a job.

You will have to either wait the 1,5 years and use the Danish rules, or find a way for your wife to get at temporary residence permit on basis of studies or (very difficult, though) work.

Family reunification on basis of children is given extremely rarely, and often denied even when the children are Danish citizens (which your children are not). Your wife is in this context 'other family member': https://www.nyidanmark.dk/en-us/coming_ ... embers.htm

Another tricky thing with the children is that permit will be given only to preserve an existing dad-mom-kids-household, not to establish one. If your wife has not been in DK on residence permit, she will not be considered having been part of your household, but merely a guest. In your world you are living together, in the eyes of the law most likely not.
