Appling for danish resident permit while on tourist visa in denmark

Indlæg af gill » 27.06.2016 13:39:11

Hello everyone :)
I am living in Denmark from six years and have a danish permanent permit since last year.
In January i got married with a non EU girl and now she is here on a 3 months tourist visa. And she is also five months pregnant. So how can we apply resident permit under danish law or can we also apply under EU law even i am not danish citizen. And what about the bank guaranty cause last year one of my friend got married with a non EU girl and they didn't asked him for bank guaranty.
I have heard that you can extend tourist visa up to 3 months more , is it true ?
My wife has a international health insurance so does it cover normal checkups and labor ? Or we can get a lawyer so it can speed up the process since she is pregnant .
Hope i can get answer for all my questions here :)
Thanks in advance :)

You can use EU-law, if you are a EU-citizen yourself. If not you can only use danish law. Please note, that it is a fundamental requirement under danish law, that one of the following is true for you:

1) You are a danish or nordic citizen
2) You are a refugee
3) You have had permanent residence permit for at least 3 years

So unless you are a refugee, family reunification under danish law will not be possible, until you either have had permanent residence permit for 3 years or become a danish citizen. And since you only got your permanent residence permit last year, this seem to be the end of the discussion for now, as far as the danish rules are concerned.

You will not be able to become Danish citizen before your child is born.

Your wife's travel insurance most likely does not cover the costs in connection with birth, as birth during travel is usually not an unforeseeable occurrence. You will therefore most likely have to pay the cost of hospital/midwife/doctor yourselves, and that can be a hefty one.

Since it is clear that you have no hope of getting the family reunion in place quickly, I would advice your wife to return to her home country as soon as possible, and give birth there, where she presumably has some kind of health insurance, and understands the language.

The process of becoming a Danish citizen you may read about here (info only in Danish, and one requirement is that your Danish is sufficient to understand the text):
