Residence permit for EU family member when working for a foreign company

Hi all,

I am an EU citizen and work for an university in Denmark, and my wife has a EU-family permit. My contract ends in November this year. In the meantime, I've got an offer from a Canadian company to work in a project related to my research for a few months. I am planning to join them in September, so my wife's current permit will expire while I'm in Canada. I don't want to leave Denmark just a few-month job, since I have other opportunities here.

My employer is happy to grant me a leave to work on this project, and I will keep my residence (pay taxes, etc) in Denmark.

My question is: Can I request an exension of my wife's permit based on a job contract with a foreign company? My employer will grant me an extension of my contract but, for the period I work in Canada, I don't know if I qualify for family reunification under EU laws.

You should ask, in writing.

As a general rule, you just have to have 'sufficient means', which you may earn wherever and in whichever legal manner you please, BUT if you commute across borders, you should spend an average of 4 nights out of 7 (normally 4 nights per week) in your bed in DK. Working in Canada that might not be possible.

When the job is temporary, it might be possible to get a dispensation from this general rule. But do be sure that you get it in writing.
