Opholdstilladelse jf. EF/EØS bekendtgørelsen

Can someone tell me the resident card issued for a spouse is of the type Opholdstilladelse jf. EF/EØS bekendtgørelsen? I applied for a university and they told me I have to pay tution fee, but I do hold the EU resident card as a spouse.

Tuition fees are decided and set by each educational institution. It is usually decided by your nationality and not by what kind of permit you have to live in Denmark.

If your residence right is granted according to EU-rules, you should be exempt from paying tuition fees at a Danish university. This is because you have a residence right, which is not time limited, as i.e. a residence permit for a specific education or an au-pair residence permit.

"Hvis du har en permanent opholdstilladelse i Danmark, eller en midlertidig opholdstilladelse med henblik på en permanent opholdstilladelse, skal du ikke betale studieafgift."

Which university have you applied to? Write to them, that since you have an unlimited residence right, you should be exempt. Write, don't call. They have to answer in writing, and refer to a rule.

Students from countries outside EU/EEA are according to Danish legislation required to pay tuition fees at Danish universities unless they are granted one of the following type of residence permit, cf. the Ministerial Order No. 1281 of 15/12/2011:

A permanent residence permit in Denmark ("Permanent opholdstilladelse")
A temporary residence permit with the possibility of a permanent residence in Denmark ("Opholdstilladelse med mulighed for varigt ophold"). Your residence card must state: “mhp. varigt ophold” or mmf varigt ophold”.
A residence permit in Denmark according to the EU/EEA regulations (Opholdstilladelse jf. EF/EØS bekendtgørelsen")
Children of workers from non-EU/EEA countries having been granted a residence permit pursuant to Section 9M (previously 9C) of the Danish Aliens Act and whose parents have been granted residence permits pursuant to Section 9A of the Danish Aliens Act."
