Hello,
I am writing to get some clarifications and or help.
I came to Denmark to be with my wife, and she was unfaithful to me. I have been here less than one year and I am also doing my masters and receiving SU. I also have a student position, ready to jump for a full time position once i graduate.
So now, my question, am I done in Denmark? I was reading that if the person is unfaithful, the process could take up to a year for full divorce. That will give me time to finish my masters and be able to get a permit through a full time job at the current company i work at.
Even though my wife did all this to me, I still plan on staying in Denmark, I love it! But if the divorce is finalized, it means that I can no longer complete my masters and have to basically start my life all over again after leaving everything behind for her.
BTW, I am not from EU, I am from US.
Is there a way I can prove I am worth of staying due to my studies and current student job? (engineering)
Will my permit be revoked immediately? Is there a possibility to extend it until the end of my studies?
Thank you so much in advance. This is a very stressful situation at the moment and I'm doing my best to stay strong with my studies.

Well, the bad new is that if you - as the only person who can - file for divorce on the grounds of infidelity, the process can be very fast if you wife admits to the infidelity. It does not even have to go to court.
The good news is, that you do not HAVE to file for divorce. If you can live with being in the same home as your wife, and she does not want to divorce, you could just leave the sleeping dogs lie.
Then, once you have graduated and found a job, you may initiate application for residence based on your job, and file for divorce.
You may not be able to use the infidelity as grounds (there is a statute of limitation of 6 months after knowledge of the infidelity), but if your wife by then also wants to call it quits, you may apply for immediate divorce without having to give any reason. As long as you agree on 1) divorce 2) financial conditions, the process is smooth, cheap and quick.

She is scared of doing that, due to being caught. And now she wants to file divorce immediately.
I don't know what to do. I am just looking to extend the possibility of revoked permit, until I finish my studies.

Well, if she applies and you do not co-sign, the process can easily drag out. One may not use own infidelity as grounds for immediate divorce.
In the meantime, and in any case, look into applying for a student visa. The downside of it is that you may only work 20 hours per week if you get it.

If i do not co sign, what are the steps for her to try to process the divorce??
Also lets say, we are not living together, can she report me and revoke my permit immediately? or will she have to wait until the divorce goes through court?
I mean, she knows she has been doing fraud since she kicked me out of the house, so I had no other option but to leave, when being cheated on.
Can i report infidelity? Or will leaving apart due to infidelity revoke my permit because of Family Reunification?
Thanks and sorry, I am just going through a lot right now.

To whom would you report infidelity? It is no crime in DK, and the only one who would suffer any consequences of your reporting that you have left her is yourself.
What your wife may or may not choose to do only she can answer.
Do please read the info on the link to statsforvaltningen you already have been given.
