Hello, our case is super complicated, I hope someone can help us.
Me and my husband are planning go back to Denmark after living in Sweden for 5 and a half months. At first, when we moved to Sweden, we thought we were going to live here for some years, but the processing times are so crazy long that we thought it would be way better just to go back to Denmark instead of spending those years in Sweden waiting for an answer.
I'm 21 years old and he is 26. We moved to Malmo so I could study in Copenhagen and we could be together. As we want to apply while we are in Denmark, waiting for the answer, what need help with the following:
-How is my husband going to enter Denmark?
Bonus information: In reality we have been living here since July 2015, but I applied at Skatteverket on the 18 of August and he has been living in Sweden with me the whole time. When I registered in Skatteveket he still had 45 days left of tourist visa within the Schengen area. Does it mean that he still have those 45 days of tourist visa as he has been living with me in Sweden as my spouse?
Bonus information: He can't go back to his home country to wait for the answer as the government in his home country is prosecuting him for being a political activist. So applying from there is not an option.
He was a student in Denmark up until 27 of June 2015 so he has a CPR number. Our idea is for him to work while we wait for the answer but do we have to apply after we are in the country or before traveling from Sweden to Denmark?
