Hello, maybe you can help me. My hsband filed for divorce and wants me out of the appartment. Not to live in it, but to sell it. He lives somewhere else nearly a year now.
Unfortunately i gave everything i had when i moved here and i have a daughter from a previous marriage.
He claims i am not entitled to half of the profit of the sale because his name was on the contract. He bought the andeels after we got married, and his omission of my name was the beginning of the end of our marriage, now that I see everything in retrospect. He also claims that i have not offered anything substNcial economically compared to his salary. It is a way to look at it since he did not " allowed" me to work, claiming a part time job would disrupt the taxes refunds he was getting from me. But i used every penny i had to our marrige to pull my own weight as much as possible. Which included the child support i was receiving, and wverything else i earned from private lessons and online jobs.
He says if we go to court, i will get nothing or very little based on those facts. Is this true? Is there a specific law measuring how long you have been married and how much you spent? I also needed to know how long does it take to get a divorce if i dont agree? The thought of being left with nothing to go on scares me as i have been here a few years and made commitments and a life, but being homeless with a few bills thrown at my face scares me more. it also enfuriates me that he throws his wife in the street and expects gratitude. As if I am the trash taken out from the back.
I was emotionally abused during the integration process and for quite a few years so now, it is crucial for me to stand up for myself. I did not realize it at first as i thought it was a matter of cultural differences, and that due to the stress of moving, some understanding was in order....even if i was devaluated on the basis of my ethnicity, gender and economic power....by the end i felt relieved he left even if i loved him....My daughter was heartbroken by his sudden exit from her life and how i handle all this is very important for her future as a woman. So to me, this divorce needs to be done in a way that i leave with my head high, and with my feet landing on ground.
I am not asking for alimony for that reason although someone says I should since he makes a lot of money. But he is out of the country and tracking his revenues could be difficult. Besides i dont wNt it. But it would be good to know that i can get it, to stop him from pressuring me so much to leave our home putting my life in a roller coaster, again.
Any thoughts?
Does the fact i did not pay for the home, or sign will have an impact ?
Should i go with the court or make a deal with my husband?
What are my best chances?
ThNk you for understanding and answering
Divorce with a twist
Re: Divorce with a twist
I think you need to find a lawyer to discuss your situation in detail.
Re: Divorce with a twist
I am sorry to hear what you have been through. It breaks my heart to know there are men like that out there.
Anyway, apart from seeking legal advise with AEG, under the menu "Raadgivning", you may also contact these people:

http://www.copenhagenlegalaid.com/
They are really nice. I am pretty sure they will help you.

Your soon-to-be-ex spouse is filling you with bulls..., of course in the hope that you will believe his lies.
You will have the right to a free attorney for the divorce case - read the info here:
http://www.civilstyrelsen.dk/Home/fri_p ... glish.aspx
If you contact one of the legal aid offices in the links evc gave you, they will help you with an application for the free attorney.
If you have not signed a pre-nup (it doesn't sound like it), you could have a right to half of your spouses assets, after deduction of the debts he had on the date of applying for divorce. He may, however, make use of the rule of 'uneven division', if you have been married less than 5 years. It does not mean that you will not get anything at all, only that you may get less than half.
However, the fact that you gave up everything you had to come to DK, is a factor in your favor, meaning that you should be compensated for this sacrifice.
Even though you don't want alimony AFTER divorce, you should consider asking for it until you actually divorce, and also (provided you have been married for about 5 years), for say - 2 years, until you have found a job, or have taken an education that enables you to work.
But discuss this with the legal aid office and your attorney.
