Burden of proof
Burden of proof
I am reading the directive and it says the host country has the obligation of burden of proff to show marriage is carried out of convience and the couple are not required so. In that case what proof they need to call marriage is of convience.
Re: Burden of proof
I just read the handbook to detect marriage of convince and it says if the spouse of non eu cannot get the immigration solely then they can be likely a fraudulent marriage. it also mentions that the marriage took place say like easy places(sweden for example) with unknown witness points to marriage of convince. As for the first I didnt appeal or followed my rejections soley due to the lawyer fess and time frame where as for the second we tried to ask friends but it was not convient for us to bring our friends and pay for there stay and such, we planned that we would do a ceremony at my wifes place around xmas. Does these 2 points can lead to refusal?
