Sweden /About apartment in DK

Hello Adviser's:

I have a rental apartment here in Denmark. I have this for like 20yrs now And I really wanted to keep this apartment even though I will move in Sweden. I dont mind paying both since this apartment I have right now is so cheap.(DK)

I plan to move in Sweden for a while to get my non EU wife with me and eventually apply EU rules back in Denmark.

Questions:
1. Is it okay to keep my apartment here in DK as long as I have My address in Sweden and I have apartment there (Sweden)too?

2. Is it acceptable in the future when I apply back in DK under EU rules? And I have apartment both Sweden & Denmark?

It's not advisable to keep two places at the same time if you wish to return to Denmark using EU rules. The authorities might think you are merely using a sham address in Sweden if you keep your place in Denmark. So you should at least rent out your place in DK while in Sweden

According to law you have a right to sublet your apartment, if for example you are going abroad. There is only the restriction that the landlord can refuse
- if the building has LESS than 13 apartments in all,
- or there will be too many residents in your apartment (more than one person/room).

But DO make sure that you draw up the contract correctly, and keep in mind that YOU are the one responsible for the rent etc. being paid on time, just as if you were living there yourself.
