Validity of Permanent Residence Permit

Hi,

I have been granted my danish permanent residence permit in the month of September 2014.

I am getting a freelancing consultancy job for 3 to 6 months in Germany.

Do I lose my permanent residency in Denmark if I take that job? (Even if I have my address in Denmark).

My second question is that since I have Danish PR, I believe I can travel in Schengen countries without requiring any visa. But for how long can I stay there? even if it is for vacation only.

You can travel within schengen area for up to 90 days. After 90 days stay you are supposed to hand in an application for a residence card or permit to stay in the other country. So the hassle free solution is not to be away for more than 90 days.

thanks for your quick response.

so will it be OK to take a contract job for 6 months and then just make a round trip to denmark for 2 after 90 days and then join back in germany?

I think the company in germany will like to sponsor my work permit for 6 months. will that effect my residency permit in denmark?

There are a number of different rules that come into play here.

With your permanent residence permit you are allowed to travel outside Denmark for a certain period of time. Within Schengen area you can travel for up to 90 days. After 90 days in the same country, you are supposed to apply for a residence permit in that country. In any case, you are not allowed to work in another country, so you have to get a work permit in that country, anyways.

You are also allowed to stay outside Denmark and even de-register your address in Denmark for a certain period of time and then able to return to Denmark later.

However, the Danish people's registry also has some laws about keeping an address in Denmark. Like if you still keep the house or flat in Denmark or if you rent it out or if someone from your household still lives there while you are travelling abroad. So there can be conflicting laws. So you should go ask Borgerservice for advice on this.

And then on top of it there is taxation which is a completely different matter, though related. If you keep your address in Denmark while working in another country, you are also supposed to pay taxes in Denmark.

Hi skaanebo,

I just called the immigration and spoke to a lady.

she said that I can stay out of Denmark for as long as one year and that should not effect my danish residence permit. even if I take a job in germany.

she suggested me to fill a form PF1 to be on a safer side.

she also said that I must maintain a danish address all this while.

Right, and so to maintain a Danish address even you aren't actually in Denmark, there are some requirements as well which you can ask at Borgerservice.

And then keeping an address in Denmark also means you are supposed to pay Danish taxes.
