I want to ask if a spouse of EU student working 10 hours can apply for resident card or does she need to show funds and such. Also if some one applying for resident card as spouse under EU law is there any chance that over stay for a month can get refusal in getting the resident card?

An EU-student only need to sign a declation, that he/she will support herself and her accompanying family members. Proof of income is not needed. However income IS needed in order to survive without starving :D

A person does not represent a threat to public safety or order just because of a visa overstay. Particularly not if that person now has an EU-residence right and therefore pr. definition can not make another overstay. So the answer to your other question is "no".

Hello

Can you please tell me if we the marriage certifcate we got from swedish kommune is enough to register in Denmark for EU spouse? or we need to request something else from swedish tax office? or we need to legalise it from Swedish foreign affairs?

The Swedish marriage certificate should be sufficient proof of your marriage (provided you married in Sweden).

I posted but wondering if it helps to rephrase. does the resident card can be denied if I dont have valid visa while applying? we gave our marriage certifcate and my wife declared about supporting.

No. The EU-rules are clear on that point. You do not need a valid visa when you apply according to EU-rules.

I told that to the lady when we are applying for resident card. But she insisted that she needs to see if I am legal here and only then I could be issued the card. To which I replied that they refused my visa in may and then appealed without any confirmation from the office. She gave a receipt only

Most likely said lady has no power of decision whatsoever, but is merely a clerk whose authority does not extend beyond receiving and forwarding applications.

They requested for a housing agreement and wondering if it is required by EU laws?

It's required in order to be registered as a resident in Denmark and to obtain a CPR number, therefore it's also required at Statsforvaltningen.

We are asked to attend an interview to find out we married just for visa purposes and wondering what should we say.

Can we say we want to stay together and live hence we got married? What is considered sham marraige? If we love and got married is that sham marriage since she wants to be with me and hence we got married?

You worry too much.

A sham marriage is a marriage where the partners aren't in love with each other, a marriage out of convenience in order to gain entry or stay in Denmark.

Sorry if I sounded worried, but getting the documents to apply for Hindersprövning and then getting a date and finally getting married took us so much time, and took a toll on us running around. And finally when we thought it is over they want to prove us this is not some convince marraige and God knows what they as and what we have to say without getting kicked out. Can they just decide it is a marriage of convince so they can?
