Hey all,

I am non-EU student in Denmark - living here for about 3 years.

I was working at an office, and got a second job in a restaurant. I calculated my hours so that I could work in both places and dont exceed the 60 hours a month (15 hours a week). Everything was good, but in one of the places I got paid 5 hours that I had not been paid for in a previous month (as I had forgetten to register them). Thus, I ended up exceeding the 60 hour rule (65 hours in total), not because I had worked more, but because my boss registered the 5 hours that I had worked in a previous month, as if I had worked them this month. I tried to talk to him, but he told me is not his problem... I dont really know what to do, as, according to the nyidenmark website, I could risk deportation and a fine. So, I wanted to know if anyone here that has experienced a similar situation - exceeded the limit of hours as a non-Eu student - can advise me.

According to nyidanmark you can work up to 20 hours/week (as of 2015):
"Work

As a foreign student following a higher educational programme or a required preparatory course which has been approved by the Ministry of Education, you are allowed to work 20 hours a week, as well as full-time during the months of June, July and August. The same applies during the job-seeking period after the completion of your educational programme. It will say on your residence card whether or not you are allowed to work.

If you work illegally in Denmark, e.g. by working more than the allowed number of hours, the Danish Agency for Labour Retention and International Recruitment may revoke or refuse to extend your residence permit. This can happen even if you otherwise meet the conditions for your residence permit, e.g. if you are still actively enrolled in your course or study programme.

If you work illegally in Denmark, you risk deportation, and you and your employer risk fine or imprisonment."

What it does not say in the English version is that you may only be deported, if you have been fined in court, been cautioned by a judge in court, accepted a fine without going to court (all of course for working illegally) or have admitted to the relevant authority (the Danish Agency for Labour Retention and International Recruitment) that you have worked illegally.

So if you have been 'given' the extra hours after 1st of January, no worry.
