Hi Everyone, I'm having 2 questions, if it's possible to get any help from here.

I'm from South Africa, I came to Denmark as a student in student visa about 5.5 years ago in (2009) and got married with a polish girl for around 2 years now, as per i have change my permit to an EU residence card (Family reunification) from my Student visa which lasted for approximate 3.5 years.

I have recently bought a House without any loans from the bank which is in my name. Me and my wife have also sign a document from a lawyer stating that any sought of property/belongings won't be separated after divorce.

We had to make Separation of properties document because she wasn't any happy living with me in longer run, Since i have whole my life savings in buying the house. I couldn't find any solution or where to get answers from. So i seek help.!

Question is :

1. If we apply for a divorce, Will i be forced to go back to my country or i can retain my stay here in Denmark because of my house?

2. Is it possible that i can apply for permanent residence? Since my 3.5 years of stay has lasted as student in Denmark and rest 2 years stay is based on Family reunification. Total stay is 5.5 years in Denmark.

If you have signed legal papers stating that you each keep what you brought into the marriage, then there should not be a problem with that. But you need a professional to assess that. And for ur further stay in Denmark, maybe you could call the Danish Immigration Service?

Since i have the house (Property) in Denmark. What happens when i divorce with my wife who is an EU citizen and we are married for 2 years and i have been living here for 5 years. We are registered as family reunification.

We have signed papers on separation of properties. So the house is technically in my belonging.

1. Will my residence permit lapse.? It is valid until 2019.
2. If it lapse, than what will be done to my house property.

Please suggest me if any solution. It will be very kind help. Thank you very much.

Your property stays your property, whether you can remain in DK or not. Lots of people own real estate in DK without living there, just as lots of Danish people own real estate in other countries without living there.

You do not write anything about whether you are working in DK, or you as a spouse of a EU-citizen just 'lie on the couch and watch tv'. Nor do you write anything about whether you have children, who will remain in DK with your wife.

Therefore it is not possible to answer your question about continued residence right.

I'm kindly sorry for not providing you with my clear information, Yes my spouse is an Eu citizen, i'm a student here in denmark and have been living for last 5.5 years and our marriage has been last for 2 years. We dont have any children.

I want to file a divorce because of many problems i'm facing now, but i'm afraid that it could impact my stay here in Denmark and my house property as well as my education.

I came in Denmark based on student visa and now i have family reunification status (EU). I dont know what could be the best way to retain my stay here.

As the spouse of an EU-citizen, you will loose your right of residence at divorce, unless:
1) your marriage has lasted at least 3 years at the beginning of the divorce procedure,
2) you have custody of common children,
3) your are in a especially difficult situation, such as if you are divorcing because your spouse has abused you, or
4) you have visitation rights regarding a minor child and the visitation is to take place in DK.

So in your case you will have to stick it out for another year, unless you can get a new student visa.

Hi, In our past conversation, you have mentioned that if i stay married in Denmark with an Eu citizen (my Wife) for 3 years, i could get rights to retain/live in Denmark (i'm non Eu).
Can you help me to find this rule .?

I have just have been separated with my wife now living in different address and i have been married for 2.5 year now. I haven't yet applied for divorce paper yet in Statsforvaltning, will this effect the 3 years been married rule, if i ask to stay in Denmark.

Familiemedlemmer med ret til at blive boende efter ophør af ægteskab

§ 15. En EU-statsborger, der har ret til at opholde sig her i landet som familiemedlem efter § 8, stk. 1, eller §§ 9-11, mister ikke retten til ophold ved hovedpersonens og dennes ægtefælles skilsmisse eller ophør af ægteskabet ved omstødelse.

Stk. 2. En tredjelandsstatsborger, der har ret til at opholde sig her i landet som familiemedlem efter § 8, stk. 1, eller §§ 9-11, mister ikke retten til ophold ved hovedpersonens og dennes ægtefælles skilsmisse eller ophør af ægteskabet ved omstødelse, hvis

1) ægteskabet ved begyndelsen af proceduren til skilsmisse eller omstødelse har varet i mindst 3 år, heraf mindst 1 år her i landet,

2) forældremyndigheden til hovedpersonens børn ved aftale eller afgørelse er overdraget til en ægtefælle, der er tredjelandsstatsborger,

3) der foreligger en særlig vanskelig situation, herunder som følge af, at ægtefællen har været udsat for overgreb, misbrug eller anden overlast i hjemmet, mens ægteskabet bestod, eller

4) ægtefællen ved aftale eller afgørelse har ret til samvær med et mindreårigt barn, og dette samvær skal finde sted her i landet.

Stk. 3. Opholdsret, der bevares efter reglen i stk. 2, er efter skilsmissen eller ophøret af ægteskabet ved omstødelse betinget af, at tredjelandsstatsborgeren er arbejdstager eller selvstændig erhvervsdrivende, eller at den pågældende råder over sådanne indtægter eller midler til sit underhold, at den pågældende ikke falder det offentlige til byrde, og at den pågældende tegner en sygeforsikring, der dækker perioden, indtil den pågældende opnår ret til ydelser efter sundhedsloven, eller at den pågældende er familiemedlem til en person, der opfylder disse krav.
