I've lived with my Danish husband and our 3 kids in denmark for 18 years. I have a permanent residency in Denmark and I would like to bring my sick mother who has no one else to care for her to live with me here in Denmark from the usa. I have spoken to the Danish immigration which have informed me that this is not possible. So now we are looking into all our other options and we need to hear if it could be possible in Sweden or does anyone know about Swedish rules and laws, where I can find out if this is possible.

Unfortunatly its not really possible after swedish law either, since the requirement is, that you and your mother have lived together in the same household, immideatly before you moved to Sweden. And that doens´t seem to be the case, since apparently you have been living in Denmark for the past 18 years and your mother in the USA.

Other close relatives

In exceptional cases, you may obtain a residence permit if you have lived outside of Sweden with your relative whom you now wish to be re-united with. This category covers, for example, unmarried children over the age of 18 and the parents of the person resident in Sweden.

Besides having lived together in the same household immediately before your family member moved to Sweden, you must also be exceptionally dependent on each other. Your dependence must have existed already in your country of origin, and it must be of a nature which goes beyond that which is to expected among family members, one which makes it difficult for the two of you to live apart.

You must submit your application as soon as possible after your relative has received a permanent residence permit in Sweden.

After EU-law it will be possible to bring her. But only if she is depending on your financial support to cover her basic costs of living. That is if she have no pension at all and solely live from the money, which you send to her every month.

For a US citizen that sounds quite unlikely to be the case. And in that case I am afraid, that you have no other options than to either pay someone to take care of your mother or go to the US to take care of her there yourself.

If you choose the latter option, please be mindfull about the rules governing how long, you can be absent from Denmark without losing your permanent residence permit. Even a "permanent" residence permit is no more "permanent", than it will lapse, if you either give up you base (bopæl) here in Denmark or is absent for a sustained period of time.

In your situation I beleive it is 2 years. But please check this out yourself, before you decide to do anything.

You could also become a danish citizen, before you leave Denmark, and then this problem will no longer exist.

As for the possibility to become a Danish citizen, there is hope that a new regulation will come into force sometime this year, which will allow you to keep your US-citizenship even if you acquire the Danish. Keep an eye out for news about that.
